O'Neill (late) Councilmen Giesser, Goggin, Lampert, <br />Saringer, Sharper, Wilamosky. <br />Also present: Mayor Ralph Christman, Lew Director Michael Gareau, Finance Director <br />William Gerlach, safety Director Ray®ond Carnahan, City Engineer J. <br />Hoa~srd Childs, Clerk of Council Nora Hill. <br />Absent: Councilman West. <br />Meeting was called to order by President Pra Tit Saringer at 8:t10 P.M. <br />Minutes of Council Meeting of March I$, 1975, were approved as read. <br />City Engineer Ghilds reported following: l) ready to take final step in sidawetlk <br />repair program that was started last smwser when notices were sent to ewers of <br />746 parcels advising them that they had sidewalks that require regsir. So far <br />almost two-thirds of those repairs have been made by the various property oaraers <br />or their contractors. There is only 2S1 of the effected parcels still requiring <br />sidewalk repairs. Have written a contract to have a contractor go in as-d make <br />those repairs: the contract is complete and ready to hand out to prospective <br />bidders. Before we do this wm nred two pieces of enabling legislation and those <br />are on agenda tonight for first resading. <br />Law Director Garesau reported followings l} During past week or so throe sessbers <br />of the North 09sASte.d Police Department were sued in Federal Court as well as the <br />Prosecuting Attorney and the City. With respect to the Prosecuting Attorney <br />have liability insurance even though suewi in his individual capacity rather Haan <br />his represssstative capacity - he is covered. All of the necessary papel'#, etc., <br />have been turned over to the insurance cemepany and are now being pre-cessed. kiCh <br />respect to the three ma~rers of the Ppliee Departma~t have discussed th.s with the <br />Mayor. Frog a legal standpoint and this is not a moral standpoint -the Cite has <br />no obligation to defend this but, of course, the Law Director, Ntayor and Viers <br />of Administration feel that we axe obligated to pursue this matter and deefetnd the <br />individuals in Court. Am in process of preparing the pleadings and filiasg in <br />Federal Goe~rt. Plan to file se:p~egrate as~+rers for and on behalf of each of the <br />three mespbers plus the City. Going to request and will prepare legislation for <br />next Council kfeeting having the City Council affirm the action the Law Director <br />is going to take; <br />2) Daring the past 2 1/2 months have been in process of preparing a clew Zonistg Code. <br />This has been accomplished. Was u~auder the mistaken impre~ssie~n, hoaewer, dusiag <br />this period of time that the Zone Map was being coordinated with this. tht the last <br />week discovered that the Zone Map hay not been prepared and there will be some <br />delay. Perhaps lir. Giesser will report on that in his Coemittee r+rport - it could <br />be perhaps 2 e~onths. Was asked an opinion as to whether or not the rough awe map <br />prepared by the gug~.neering Dept. could be attached to the Zeming Cede which r~uld <br />be introduced and in Law Director Gareau's op~.nion because it is an uascaled sstp <br />it is not accurate and we would run into too many legal problems is the future <br />with respect to this.
