~~~~ <br />MINUTES OF TBE MEETING OF THE COUNCIL <br />of THE cIT~ aF ~ vBTaD <br />NOVEM!!BR 1, 1977 <br />Present: President Dewey Liae~rt, Councilmen Beaty, Boehmer, Fairfield, Beringer, <br />Sharpe, West, Wilaeeosky. <br />Also present: Mayor Ralph Chriatssn, Law Director Michael Gareau, Safety Director <br />Richard Roharik, Service Director Harry Caster, City i~ugineer J. Howard <br />Childs, Clerk of Council Nora Bill. ' <br />Meeting was called to order by President Lampert at 8:00 P.M. <br />Minutes of Council Meeting of October I8, 1977, were approved as read. <br />City Bangineer Childs reported: 1) last Friday attended a meeting dealing with <br />subject of urban flooding and draiaage problems. Mrs. Beringer was also in <br />attendance. The meeting was sponsored by A~OACA and officials ire there from <br />various departments of the Federal Gorntaent, various State officials as well <br />as the NOACA people: they had three panel discussions, one by ledesai officials, <br />another bq Btate officials and a third by NOAC~A is each case outlining wteat these <br />various branches of government can do and are doing to help the various eicipali- <br />ties with their flooding problems Heard pretty much the same story that most of <br />us have heard before mainly that the nosey is not there and the govercut organiza- <br />tion is not there to really do a lot to heap the various municipalities with actual <br />construction activities to alleviate hooding. They can do studies but that is <br />about all they can do within the limitations of their present resources. They say <br />the Corps of Engineers is restricted from getting into anything in construction area <br />to help come4unities with flooding unless they can show that the be~rfit that will <br />accrue from the project will exceed the costs; and this rules out about 99x of the <br />things that they are asked to look at. Mr. Childs discussed the fact that the <br />Ohio Dept. of Natural Resources are liaa3ted by budget and have to restrict them- <br />selves to just the highest priority, etc., so they get around to vezy few when <br />it comes to the construction phase of it. While greeting was in pro~Ceas Mr. Qiilds <br />took opportunity to state what we are doing in North Olmsted to avoid flooding <br />problems here - outlined what we !save been doing to install storm water retention <br />basins in various new developo~eta in the City during the last five years. Also <br />pointed out that during duet span of years even though we have had a lot of dev~lop- <br />ment does not think we have iacrel our flooding problems any during that period <br />because of the retention basins. They are trying to seeks the point that eveen <br />though the large sums of nranay are not' there for an areaaide solution to the problem <br />there is a lot that each indiv+~a1 comity can do on their own; <br />2) had our second bid opaaring oo Claque Rd. Culvert an October 28th, 1977. Do have <br />a good low bid from the saw contractor that was the Iow bidder before and far <br />the eases dollar bid. It looks like a viable bid and will be recasslending that we <br />proceed with the contract. <br />Law Director Garesu reported: 1) with respect to the Burkett Case vs. City of North <br />Olmsted: have completed all discovery; took depositions for 2 1/2 days. Haws also <br />filed Motion for Summary Judgseaat. Ttws case is set for trail in Decarrber sad expects <br />~ that prior to that time the Motive fox Sus~oeary Judgsxatet will be ruled on sad we <br />will either for forward or the City will be out of the case; <br />2) with respect to the Bush Case as far as the mandasus action: did have a <br />settlement and the judgment entry was reheated in the dailq I.egsl Nuts; however, <br />a couple of days later somebody chsaged their minds and we are still back in the <br />case - that is the mandamus action, and are having a bearing on that Nov~er 17th. <br />
