<br /> <br />MINUTES OF THE MEETING OF THE COUNCIL <br />OF THE CITY OF NORTH OLMSTED <br />MARCH 15, 1977 <br />Present: Councilmen Beaty, Boehmer, Fairfield, Saringer, Sharpe, West, Wilaseosky. <br />Also present: Mayor Ralph Christman, Law Director Michael Gareau, Service Director <br />8enry Caster, City Engineer 3. Howard Childs, Clerk of Council Nora Rill. <br />Absent: President Dewey Limpext. <br />Meeting was called to order by President Pro Tem Saringer at 8:00 P.M. <br />Clerk of 6ouncil reported to Council that the signatures on Referendum Petition <br />relating to Ord. No. 77-2 have been checked and there are sufficient signatures. <br />Mr. Fairfield moved to repeal Ord. No. 71-2, seconded by Mr. Wilamosky. Affirmative <br />vote: Fairfield, Saringer, Wilamosky. Negative vote; Beaty, Boehmer, Sharpe, West. <br />4 Nags - 3 Yeas - Motion defeated. <br />Mr. Fairfield moved that. Ord. No. 77-2 be placed on the ballot in November, <br />seconded by Mr. Wilamosky. Discussion ensued. Mr. Beaty questioned if this <br />would not automatically go on the ballot by virtue of the referendum if we do not <br />repeal it, or do we have to move to put it on the ballot. Law Director Gareau <br />stated Council has two choices of action - it is a positive action and not a <br />negative action. Does not think by voting down the motion to repeal necessarily <br />puts it on the ballot - Council has 30 days within which to act. Thinks motion of <br />Mr. Fairfield is proper at this time. Discussion ensued. <br />Mr. Beaty moved to postpone vote to date certain of March 29, 1977, 7:30 P.M., at <br />a Special Meeting of Council, seconded by Mr. Boehmer. Affirmative vote: Beaty, <br />Boehmer, Sharpe, West. Negative vote: Fairfield, Saringer, WilamDSky. 4 Yeas - <br />3 Nays - Motion carried. <br />Law Director Gareau was requested by Mr. Wilamosky to explain to the audience <br />what will result if Ord. No. 77-41 is not passed with 5 votes this evening.. <br />Law Director Gareau stated if Ord. No. 77-k1, commonly known as the rollback <br />ordinance does not pass with 5 votes, it will not go into effect for 30 days <br />and consequently it has no effect on Ord. No. 77-2 until the 30 days has passed. <br />Mr. Wilamosky verified with Law Director Gareau that following the vote oa Ord. <br />No. 77-41 Council can deal with Ord. No. 77-2 immediately following. Law Director <br />Gareau stated Council can deal with it at anytime. <br />Minutes of Council Meeting of March 1, 1977, were approved as read. <br />Mayor Christman reported: 1) In light of the priorities that were sent down to <br />the County for use of Com~aunity Development Block Grant Program - would like to <br />recommend that Council consider reapplying under the Open Spaces Grant a program <br />fox the reclamation of the landfill area. Thinks we could increase our state <br />participation in this project and perhaps make it a viable one to go n~;xt year; <br />2) attended the Ohio Municipal League Legislation Conference today and copies of <br />the legislative policies that have been adopted by the League will be foratarded <br />to Council. Of the utn~st concern is the collective bargaining legislation that <br />they feel will be coming from the State Legislature and how it will affect I~iorth <br />Olmsted; <br />3) request suspension of rules on Ord. No. 77-46 to enable us to g,~sar up and <br />collect our own sewer charge for collection by the City iostead of the City of <br />Cleveland. <br />
