~, . <br />r <br />MINUTBS OF THE MBBTING QF THB COUATCIL <br />OF .THE CITY OB O~.MSTED <br />FEB~TARY 15, 1977 <br />Present: President Dewey Limpert, Councilmen Beaty, Boehiser, Fairfield, Beringer, <br />Sharpe, West, Wilamosky. <br />Also present: Mayor Ralph Christman, Law Director Michael Gareau, Safety Director <br />Raye~-ond Carnahan, Service Director Henry Caster, City Engineer J. Howard <br />Childs, Clerk of Council Nora Hill. <br />Meeting was called to order by President Lampert at 8:00 P.M. <br />Minutes of Special Council Feting of January 31, 1977, were approved as read. <br />Minutes of Council Meeting of February 1, 1977, were approved as read. <br />Mayor Christman reported: 1) have received a proposal from the Department of <br />Transportation for the reeurfacitig of Coluabia Rd. from Braokpark Rd. to North <br />Olmsted's north corporation limit - a lsasgth of 1.71 miles. Our portion of this <br />project would be $12,32fl. Would like to recommend that Council favorably consider <br />this and pees the required legislation. Requested same be put into Committee; <br />2) had previously submitted the name of Mr. Fred Carlton for appointment to the <br />Board of Zoning Appeals - received a phone call from him this week requesting that <br />his name be withdrawn from consideration of the appointment. Have not chose another <br />appointment for this slot yet. <br />Mr. West asked if they are going to repave that portion of Columbia Rd. are they <br />$aying that relocation of 2S2 is so far off that they want to spend money on that <br />portion. Mayor Christman commented no - he does not think that is it: about 10 <br />years ago they resurfaced it and it is in bad condition especially Wirth of Lorain <br />Rd. Does not lutoir how far off the portion of 2S2 relocated north of Lorain Rd. is <br />but certainly thiaka this warrants our consideration. Mr. Wilamosky asked whet <br />percentage of $12,320. represents. Mayor said he believes it is the same as <br />Lorain Rd. - 24X. <br />Law Director Gareau reported: 1} over a period of time'~ve had a great deal of <br />problems with respect to claims basing filed for unemploymee~t compensation arising <br />oft of the Rec Center, and have generally fought these requests where there has <br />beam a discharge or people have quit. In the last tenth Mr. Garesu and Mr. Bronder <br />appeared before a Bearing Board with rs~speet to the discharge of the Food Service <br />Manager. 1'tre discharge was upheld by the Agpellate~ Board of the Unea~loyment <br />Compensation Horsey. It is presently being appealed; <br />2) sometime ago reported on the Suns' cases there were in the Court of Common <br />Pleas: the Board of Zoning Appeals was upheld. Have not had appeals taken in <br />the cases althoagh certain things were requested. Consequently the judgements in <br />Chose cases are in the City`s favor; <br />3) the Sewage Treatment Plant ease - Burkett vs. City of North Olmsted, has been <br />assigned to a new Judge so suspects that within the n:srfuture will have some <br />.activity on that score; <br />4) the Mayor this past week has presented the Law Director with a request from the <br />Legal Aid Commission of Cuyahoga County dealing with indigent cases. Rad occasion <br />to talk to Judge Holmes in Rocky River Court and found that; we had approximately <br />80 indigent cases emanating out of the City of North Olaast®d at~ually. Probably <br />about 50 of those are felony cs~ses. Nave written to the Gotamission asking them <br />to provide us with information regarding what it would cost the City to have them <br />
