CITY OF NORTH OLMSTID, AND THE PERMA1GfENT CLOSING <br />OF FOUR POINTS OF ACCESS AT OR NEAR T~3E INTF~t4EGTI0N <br />OF SR 17 AND SR lO, FOR THE PURPOSES OF AFFO~I~4'G <br />BETTER CONTROL OF TRAFFIC IN AND TO THE PROP03EA <br />SHOPPING CENTER TO BE LOCATED SOUTH OF THE INTERSECTION <br />OF SR 10 AND. SR 17, AND DECLARING AN Ei~RGENGY. <br />WHEREAS, the Council of the Cit of North Olmsted has heretofore <br />in Ordinance 1979, passed May 5, 195~s consented to the irovement <br />of Brookpark Road (SR 17) according to the plans filed with the City <br />by the State Director of_~iighways, reflecting Brookpark Road within <br />the corporate limits of the City as a li~n3.ted access highway and <br />indicating points of access to said Thoroughfar®, and <br />WHEREAS, other conditions are contained in said Ordinance of <br />Consent and the obligation of the City for the maintenance of said <br />Thoroughfare when compl®ted, and <br />WHEREAS, at a point Southerly from the intersection s>f Brookpark <br />Road and Lorain Road (SR 10), a proposed shopping canter Frith parking <br />area has been submitted to the City of North Olmsted and approved, and <br />WHEREAS, the size of the shopping center and its location has <br />caused. the Council to give considerable study to the r®sultng traffic <br />control problem which would be created and its direct relation to traff is <br />on Brookpark Road and Lorain Road, and <br />t^lHEREAS, the developer of the said proposed shopping center, co- <br />opsrating with the City of North Olmsted, in an endeavor to plan the <br />development in such a manner as to bring about the xaost effective and <br />simplest proposal for the control of traffic to and from said shopping <br />center from the aforesaid thoroughfares, and <br />WHEREAS, the developer has retained The H. K. Ferguson Company, <br />Engineers, to assist in the planning of the most effective traffic <br />control, and <br />tJHEREAS, said proposed plan has been studied by the Council of <br />the City of North Olmsted and believes that said proposed plan is the <br />most efficient and effective solution of the control of traffic to <br />and from said propos®d shopping center particularly as it contemplates <br />the permanent closing of four points of ace®ss located at or immediately <br />East on the Southerly side of Brookpark Road at its intersection with <br />Lorain Road, and <br />.WHEREAS, the obligations of the City of North Olmsted are in no way <br />to be avoided or nullified under and pursuant to the fined obligations <br />heretofore established to be perform®d by the City of Forth Olmsted, as <br />to the Facility, and <br />~rtHEREAS, it is contemplated that the proposed access point to <br />Brookpark Road will include the necessary planning for drainage of <br />said point. $o as not to overload the present Brookpark Road system <br />as laved out, and <br />ti^rEREAS, the City afire®s that the location of such access point <br />does not in any way void any obligation they have for the maintenance <br />for the Facility. <br />NOW, TIi~REFORE, BE IT ORDAINED by the Council of the City of <br />North Olmsted, Ohio, two-thirds of all members elected thereto con- <br />curring: <br />
