Section 3. That sub-section (c) of Section ~ of Ordinance No~1786, <br />as amended from time to time, now reading: <br /> <br />"(c) Class la use is intended to be supplementary~n!y. Districts <br />so classified shall remaih classified as la or lb use districts, as <br />the case may be, and subject to all restrictions of class la and lb <br />uses except as provided in Section 5 (b)." <br /> <br />shall be, and it is hereby, amended to read as follows: <br /> <br /> "(c) Class lc home occupational uses and class Id off-street parking <br /> use are intended to be Supplementary only. Districts so designated <br /> shall remain classified as la or lb residence districts, as the case <br /> maybe, and subject to all restrictions of class la or class lb uses <br /> exc~ ~rov~ded in ~ection ~," <br /> <br /> Section ~, That Section 5 of Ordinance No. 1786, as amended from <br />time to time, be amended and supplemented by adding thereto a new sub-division <br />(c) to read as follows: <br /> <br /> "(c) Notwithstanding the provisions of paragraph (a) of this section, <br /> premises located ~mthin a class id residence (use) district, as such <br /> (supplementary) districts are designated on the ZOne Map from time to <br /> time by action of Council, may be used for parking of motor vehicles <br /> upon the granting of a permit therefor as hereinafter specified, <br /> <br /> The City Planning Commission is hereby empowered to authorize, sub- <br /> Ject to review by the Council, the issuance of permits for the park- <br /> ing of motor vehicles on premises located within a class id residence <br /> district in the method and manner and subject to conditions and limit- <br /> ations, as follows : <br /> <br /> (1) Written application for any such permit shall be filed with the <br /> City Planning Director by the owner or lessee cf the premises stating <br /> name, address, and interest in the prem~.ses as owner or lessee to- <br /> gether with the description and street location of the pr~m~ses and <br /> such further information as may be prescribed by the City Planning <br /> Commission. <br /> <br />(2) The City Planning Director shall submit such application to the <br />City Planning Commission at its next meeting together with such <br />further information with respect to such applicant, application, and <br />the premises, as may be available to him. <br /> <br />(3) No permit shall be issued or authorized to issue until and unless <br />the City Planning Commission shall: <br /> <br />(a) Hold a public hearing with respect to any such application <br />after notice given as required by section 21; <br /> <br />(b) Affirmatively find that the proposed parking use will be for <br />substantial public benefit; <br /> <br />(c) Affirmatively find that the proposed parking use, subject to <br />such conditions and restrictions as may be imposed, will not re- <br />sult in substantial detriment to neighborhing residential property; <br />and <br /> <br />(d) Affirmatively find that the applicant is the owner or lessee <br />authorized to so use the premises and ascertain that such applicant <br />will eccept, in writing, the permit and such conditions and restric- <br />tions as may be imposed thereon. <br /> <br /> <br />
