-5 <br /> <br />329.115 License to Operate. <br /> <br />No person shall'operate or maintain a swiraming pool until <br />a license there£or shall have been issued by the Commis- <br />sioner of Health. The license £or a family swiaing <br />pool shall be issued £or an inde£inite period but shall <br />not be transferrable as to person or tn¢&tion. The li- <br />cense for a public swimmin§ pool shall be issued yearly, <br />~nd a new license shall be secured On or before May 1st <br />of each year, which will permit operatipn or maintenance <br />until the fo!lo~ng April 30th. All licenses shall be <br />in ~riting and shall state the conditions thereo£ and <br />the term for which the license is granted. It shall be <br />unlaw£ul for any person to conduct, operate, maintain or <br />manage any swimming pool without complying with the re- <br />quirements of this code, and the Health and Building <br />Divisions are charged with the en£orcement o£ the provi- <br />sions hereo£. <br /> <br />329.116 Revocation o£ License. <br /> <br />Any license granted by the Commissioner o£Health here- <br />under may be revoked by him for failure to comply with <br />rules and regulations promulgated hereunder or with any <br />provisions o1 this code, or whenever in the determination <br />o£ the Commissioner o£ Health, further operation under <br />such license creates a menace to the health, safety, or <br />morals of the users of the swimming pool, provided that <br />the holder of any llcense ~tich has been revoked may <br />appeal from such revocation in writing within thirty (30) <br />days o£ such revocation, to the city council, and the <br />city council shall, at its next regular meeting deter- <br />mine the legality or reasonableness of the revocation of <br />the license. No appeal under this section, however, <br />shall entitle the license holder to continue operation <br />of the swimming pool pending action of the city council. <br /> <br />329.117 Inspection. <br /> <br />The Commissioner of Health shall inspect or cause to be <br />inspected all pools ~thin the city at such times as he <br />may deem necessary to carry out the intent of this code. <br />The Commissioner of Health, or his duly authorized rep- <br />resentatives, is hereby authorized to enter upon any <br />premises, private or public, to take such samples o£ <br />water from such pools at such times as he may deem nec- <br />essary and to require the owner, proprietor or operator <br />to comply with the provisions of this code. In the event <br />of the failure o£ compliance after due notice with any <br />provisions of this code, the Commissioner of Health shall <br />have the power to abate or cause a suspension o£ the use <br />of such pool until such time as the same is, in the <br />opinion of the Commissioner of Hea~th, no longer a menace <br />or a hazard to health, sa£ety or morals. <br /> <br />329.118 C~,~pllance !?ith Requirements of State ;)epa~i::aeat <br /> of Health. <br /> <br />In the construction, operation and maintenance of any <br />$~inuning pool, laws o£ ~he State of Ohio and the rules, <br />regulations and requirements o£ the State Department o£ <br />Health shall be observed.
