-6 - <br /> <br />between the provisions of this code, and any provision <br />of state law or requirement, rule or regulation of the <br />Ohio Department off Public Health, the provision imposing <br />the higher standard or the more stringent requirement <br />shall be controlling. <br /> <br />329.119 Sa£ety o£ Bathers. <br /> <br />All reasonable precautions shall be taken to protect the <br />users o£ public and family swimming pools from injury <br />or accident. Convenient means of ingress and egress <br />shall be provided and the depth of water and any irregu- <br />larities o£ the bottom shall be. clearly indicated. <br />Safety appliances such as lifebuoys, llfe hooks, bamboo <br />poles, or ropes and equipment including first-aid kits <br />shall be provided and be readily accessible. <br /> <br />329.120 Polluted Uater. <br /> <br />No body o£ water, whether it be a natural or an artifi- <br />cial body of.water in the city which contains sewage, <br />waste or other contaminating or polluting ingredients <br />rendering the wate~ hazardous to health, and no body of <br />water ~hich fails to meet the requirements of this code, <br />shall be used £or swimming or bathing purposes by any <br />person or persons. <br /> <br />329.121 Shielding Lights. <br /> <br />Lights used to illv~.inate any pool shall be so arranged <br />and shaded as to re£1ect light a~,~y from adjoining prem- <br />ises and public streets. Such lights shall be turned <br />off at 11:00 otclock P.~. and shall remain off until <br />7:00 o~clock <br /> <br />329.122 Unnecessary ~oise. <br /> <br />Xt shall be unlawful for any person to ma!ce, continue or <br />cause to be made or continued at any pool, any loud, un- <br />necessary or unusual noise or any noise which annoys, <br />disturbs, injures or endangers the comfort, repose, <br />health, peace or safety of others. In thC operation <br />of a pool, the use or permitting the use or operation <br />of any radio, receiving set, musical instrument, phono- <br />graph or other machine or de~ice for the 'producing or <br />reproducing of Sound in such manner as to disturb the <br />peace, quiet and comfort of the neighboring inhabitants, <br />or at any time ~ith louder volume than is necessary for <br />convenient hearinc of the person or persons who are in <br />the pool premises shall be unlawful. <br /> <br />329.123 Enclosure of Swi~mnin§ Pool. <br /> <br />Bvery outdoor swimmin§ pool shall be completely surround~ <br />ed by an appropriate fence not less than six (6) feet in <br />height for public s~i~ain§ pools, and not more than <br />seven (7) feet nor less than four (4) feet in ~ei~ht for <br />family swimming pools, and such fence shall be located <br />not nearer than eleven (11) feet to any property line. <br />A building or e×istln~ wall may be used as a part of such <br />enclosure. <br /> <br /> <br />
