NOW, 'rflERI,;I,'OI~E, the prettier; hereto, each in con$~(lcration of <br /> <br />the mutual promises and obliger±ohs set forth here±n, agree as follows: <br /> <br /> 1. For the purpose of af£ord±ng additional public service <br />ass±stance and protection o~ l±fe~ limb aml property to themselves and <br />their inhabitants, there shall be an ±nterchange of the services of the <br />public service departments, and use of public serv±ce personnel and equip- <br />ment, betx¢een the part±es hereto, and each of said parties w±ll assist <br />the other party hereto by responding to any call from the Mayor, <br /> <br /> or other party designated by him, being <br /> <br />a member of the municipal corporat±on which is a party to this agreement~ <br />with its public serv±ce~equipment~ personnel, and/or other veh±cles~ and <br />will render like services wh±le so respouding as ±t renders to itself and <br />~ts o~m ~nhabitants, prey±tied, however, that in no case shall the party. <br />hereto called upon or rendering such se~wice be liable in damage to the <br />other-party hereto or any of its inhabitants, or contractual obligees, for <br />failure to answer any call, or for lack o~ speed in ansx,ering any such <br />call, or for any inadequacy of equipment, negligent operation of' equipment, <br />or for any cause whntsoever growing out of such use Of said public service <br />equipment and personnel, nor shall the party hereto, ~hich issued such <br />call, be liable in any manner or event for damagr,.s or loss of equipment <br />.or personnel suffered by the party answering such call. <br /> <br /> 2. Each of the parties hereto agrees to respond to an emergency <br />in the other contracting mtmicipal corporations, on the call from the <br />Mayor, Director of Public Service & Properties, or other party designated <br />by them, of such other contracting municipal corporation~ for services of <br />the public service department and public service equipment at those times <br />and places that would tend to require immediate or long-.term participation <br />of public services of two (2) or more of the municipal corporations being <br />a party to this agreement. The extent of such response by said responding <br /> <br />municipal corporation shall be determined by the judgment of the Mayor, <br /> or ot.h¢,.r party designat:ed by himi' <br />~.~ho shall ret;tin in said municipal cor[>oration sufficient equipment and <br />personnel consistent with the proper functioning of said responding munici- <br />pal corporations. <br /> <br /> <br />
