BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />LAKEWOOD, COUNTY OF CUYAHOGA, STATE OFOHIO: <br /> <br /> Section 1. Definitions. Any term used in this <br />Ordinance and defined in the Original Indenture shall have <br />the same meaning herein as therein unless such term is <br />otherwise defined herein or unless the context otherwise <br />indicates. As used herein, the following terms have the <br />following meanings: <br /> <br /> "Bonds" means the Original Bonds (referred to in <br />the Original Indenture as the "Improvement Bonds"), the <br />Series 1982 Bonds, and any other Additional Bonds from time <br />to time outstanding. <br /> <br /> "Bond Legislation" means the Original Bond Ordi- <br /> nance, this Ordinance, and any other legislation providing <br /> for the issuance of other Additional Bonds, but only to the <br /> extent that such other legislation is consistent with the <br /> Original Bond Ordinance, this Ordinance, and the Indenture. <br /> <br /> "Depreciation Reserve Fund" means the Depreciation <br /> Reserve Fund created pursuant to Section 6 hereof, which <br /> shall constitute a "Special Fund" for purposes of the <br /> Indenture. <br /> <br /> "First Supplemental Indenture" means that certain <br /> First Supplemental Trust Indenture, to be dated as of <br /> February 1, 1982, between the Issuer and the Trustee, includ- <br /> ing this Ordinance as a part thereof. <br /> <br /> "Indenture" means the Original Indenture as amended <br /> and supplemented by the First Supplemental Indenture, and as <br /> further amended and supplemented by the Second Supplemental <br /> Indenture when and if the Second Supplemental Indenture is <br /> executed and delivered in accordance with Section 1102 of <br /> the Original Indenture, and as the same may be amended, <br /> modified, or further supplemented in accordance with the <br /> provisions thereof. <br /> <br />-3- <br /> <br /> <br />
