may perform his duty of safeguarding the health and safety of the occupants <br />of dwelling units and occupiable structures and of the general public and to <br />determine whether they cc~form to the provisions of this O0de. Such <br />inspections may also be made whenever the Building Ccmmissioner has <br />reascnable cause to believe that a violation of this Code exists therein or <br />thereon. <br /> <br /> Section 15. That Section 1305.50 of the Building Code of the Codified <br />Ordinances nc~ reading as follows: <br /> <br />1305.50 <br />(a) <br /> <br />(b) <br /> <br />(c) <br /> <br />For the purf~se of raking such inspections 'the Building <br />c~,.,~ssioner, u~m presentation of proper credentials is authorized <br />to enter, examine and survey at all reasc~able times all dwellings, <br />dwelling units, rooming units, structures and premises provided f~r <br />in this Code. The owner and occupant of every such dwelling, <br />dwelling unit, rooming unit and structure and the person in charge <br />thereof shall give such official free access to such dwelling, <br />dwelling unit, rooming unit and premises at all reasonable times <br />for the purpose of such inspection, examination and survey. <br />Every occupant of a dwelling or dwelling unit shall give the c~ner <br />thereof or his agents and employees access to any part of such <br />dwelling or dwelling unit or its premises at all reasonable times <br />for the purpose of making such repairs or alterations as are <br />necessary to effect compliance with 'the provisions of this Oode. <br />Except in emergency situations, no penalty under the penalty <br />provisions of this Code shall apply against any owner who refuses <br />the right of entry hereunder until a search warrant is obtained. <br /> <br />shall be and the same is hereby amended to read as follows: <br /> <br />1305.50 <br />(a) <br /> <br />(b) <br /> <br />(c) <br /> <br />For the purpose of making such inspections, the Building <br />Commissioner, upon presentation of proper credentials is authorized <br />to enter, examine and survey at all reasonable times all dwelling, <br />dwelling units, rooming units, occupiable structures, structures <br />and premises provided for in this Code. That Paragraphs (a), (b) and (d) of Section 1305.52 of the <br />Building Code of the Codified Ordinances now reading as follows: <br /> <br />1305. <br />(a) <br /> <br /> 52 REPAIR CF HOUSING (I)DE VIOLATIONS. <br /> Examination by. Buildin~ C~=dssioner. The Building Cc~..,issioner <br /> shall examine or cause to be examined every dwelling structure or <br /> appurtenant structure and/or premises reported to be in violation <br /> of any of the provisions of the Housing Code and shall make a <br /> written record of such examination. <br />(b) Notice of. Violation_ and Order to Repair to Owner or Person in <br /> Control. Whenever the Bui-i~--ng-~,~issic~-~r'~-~--ermi--nes ~--~ any <br /> dwelling structure or appurtenant structure and/or premises is in <br /> violation of any of the provisions of this Housing Oode, but that <br /> such violations do not result in such structures or premises being <br /> a public nuisance, he shall give written notice of violation and <br /> order to repair to the owner or person in control thereof. <br />(c) ... <br />(d) Service of 51::~..ice and Order.
