36) Watercourse - A channel in which a flow of water occurs,
<br /> whether continuously or intermitently.
<br />
<br />37) Waters of the State - Ail streams, lakes, ponds, marches,
<br /> watercourses, waterways, wells, springs, reservoirs,
<br /> acquifers, irrigation systems, drainage systems and all
<br /> other bodies or accumulations of water, surface or under-
<br /> ground, natural or artificial, public or private, which
<br /> are contained within, flow through, or border upon the
<br /> State or any portion thereof.
<br />
<br />Section 913.03: USE OF MUNUCIPAL SEWERS REQUIRED
<br />
<br />a) It shall be unlawful for any person to place, deposit, or
<br /> permit to be deposited in any unsanitary manner upon public
<br /> or private property within the municipality, or in any areas
<br /> under the jurisdiction of said municipality, any human or
<br /> animal excrement, garbage, or other objectionable waste.
<br />
<br />b) It shall be unlawful to discharge to any .natural outlet
<br /> within the municipality, or in any area under the juris-
<br /> diction of said municipality, any wastewater, industrial
<br /> wastes, or other polluted waters, except where suitable
<br /> treatment has been provided in accordance with subsequent
<br /> provisions of this ordinance.
<br />
<br />c) Except as hereinafter provided, it shall be unlawful to
<br /> construct or maintain any privy, privy vault, septic tank,
<br /> cesspool, or other facility intended or used for disposal
<br /> of wastewater.
<br />
<br />d) The owner of all houses, buildings or properties used for
<br /> human occupancy, employment, recreation, or other purpose,
<br /> situated within the municipality and abutting on any street,
<br /> alley or right-of-way in which there is now located or may
<br /> in the future be located a public sanitary sewer' of the
<br /> municipality, is hereby required at his expense to install
<br /> suitable toilet facilities therein, and to connect such
<br /> facilities directly with the proper municipal sewer in
<br /> accordance with the provisions of this ordinance, within
<br /> ninety (90) days after date of official notice to do so,
<br /> provided that said municipal sewer is within a reasonable
<br /> distance as determined by the City Council.
<br />
<br />Section 913.04: INDIVIDUAL WASTEWATER DISPOSAL
<br />
<br />a) Where municipal sanitary sewer is not available under the pro-
<br /> visions of Section 913.03, the building shall be connected to
<br /> an individual wastewater disposal system complying with the
<br /> provisions of the Cuyahoga County Sanitary Engineering Depart-
<br /> ment.
<br />
<br />b) At such time as a municipal sewer becomes available to a pro-
<br /> perty served by an indiVidual wastewater disposal system, as
<br /> provided in Section 913.03, a direct connection shall be made
<br /> to the municipal sewer in compliance with this ordinance, any
<br /> septic tanks, cesspOols, and similar individual wastewater
<br /> disposal facilities shall be abandoned and filled with suit-
<br /> able material at the owner's expense.
<br />
<br />c) No statement contained in this article shall be construed to
<br /> interfrere with any additional requirements that may be im-
<br /> posed by the Lakewood Health Commissioner.
<br />
<br />Section 913~.05: BUILDING SEWERS AND CONNECTIONS
<br />
<br />a) No unauthorized person shall uncover, make any connection with
<br /> or opening into, use, alter, or disturb any municipal sewer or
<br /> ~. appurtenance thereof without first obtaining a plumbing permit
<br />~ ~'.~ from. the City Building Department and a street opening permit,
<br /> where applicable, from the Public Works Department.
