non-public purpose portion of the Redevelopment Properties and <br />construction of the Project, or if there is any application to <br />be filed or consent or approval to be obtained by or from the <br />City which if not filed or obtained would give rise to <br />circumstances that would impair or hinder the development of <br />the non-public purpose portion of the Redevelopment Properties <br />.and construction of the Project, or if there exists any other <br />objection to the City's title, other than as shown on the <br /> <br />aforementioned title insurance commitments, the title shall not <br />be good and indefeasible within ~the meaning of such term as <br />used herein. In. the event the City fails to show an <br />indefeasible title as herein required within ninety (90) days <br />after notice of such objection; 'Redeveloper shall have the <br />option of terminating this Agreement without any further <br />obligation or liability of Redeveloper, or Redeveloper may <br />waive such objections, defects or' encumbrances; provided, <br />however, that the'City shall use all reasonable efforts to <br />remove or cure any such objections, defects or encumbrances <br />Within such ninetY (90) day period. <br /> <br /> (k) Rezoning. <br /> <br /> City 'and Redeveloper recognize that portions of the <br /> <br />Project Area may need to be rezoned to other zoning <br />classifications and certain variances, 'including, but not <br />limited to zero lot lines must be granted in order to permit <br />Redeveloper to construct the Project contemplated hereunder. <br /> <br />It is anticipated that any such rezoning of or variances on the <br />Project Area to permit construction of the Project will be <br /> <br />- 11 - <br /> <br /> <br />
