Subdivision of such consolidated parcel(s) shall require prior <br /> City Planning Commission approval in accordance with governing <br /> law. <br /> <br /> (c) Deed. <br /> <br /> The City shall convey to Redeveloper good and <br /> <br /> indefeasible fee simple title to the portion of each <br /> <br />.Redevelopment Property not required for municipal public <br /> purposes by general warranty deed (hereinafter sometimes <br /> referred to as a "Deed") in substantially such form as set <br /> forth in'Exhibit B attached hereto and made a part hereof. <br /> Such conveyance ·and title shall be free and clear of all liens <br /> and encumbrances whatsoever ·except those easements, <br /> restrictions, covenants, reservations, limitations and <br /> condition, if any, of record approved by Redeveloper <br /> ("Permitted Exceptions,,).. <br /> <br /> ~(d) ApDortionment of Taxem~. <br /> <br /> · The portion of current real property taxes 'and <br />assessments, if any, on the non-public purpose portion of a <br />Redevelopment Property which is a lien on the date of delivery <br />of the Deed to Redeveloper shall be apportioned between the <br />City and RedeVeloper as of the date of the delivery of the <br />Deed. If the amount of the current taxes on a Redevelopment <br />Property is not ascertained on such date, the apportionment· <br />between the City and Redeveloper shall be on the basis of the <br />amount of the most recently ascertainable taxes and said <br />apportionment shall be final. <br /> <br />- 6 - <br /> <br /> <br />
