Such documents shall he maintained <br />on permanent confidential file by the Division of Police, to be made available only <br />through subpoena by a court of record. <br /> <br />(c) Any person who sells or otherwise transfers possession of a reuistered handgun <br /> shall surrender the registration receipt for such handeun with the name, address <br /> and social security number, of the buyer endorsed thereon, to the Division of <br /> Police. <br /> <br />(d) No person shall sell, purchase, own, IX~ssess, transfer, give, deliver, receive or have <br /> on or about his person tlr use any handgun which does not contain an engraved <br /> serial number or other numerical identification pursuant to federal law and <br /> regulation. <br /> <br />(e) Whoever violates subparagraph (d) of this section is guilty of a misdemeanor of the <br /> first degree. <br /> <br />SECTION 549.26 DOMESTIC RELATIONS ABUSE PREVENTION; WEAPONS <br />SURRENDER <br /> <br />(a) If, upon motion of the City, the Court finds that the safety and protection of the <br /> complainant or other family or household member is impaired by the defendant <br /> possessing a weapon or firearm, it shall order the defendant to immediately surrender <br /> all firearms, handguns, rifles, shotguns, deadly weapons and ammunition which that <br /> person then possesses to the Division of Police. <br /> <br />(b) Notice of such ordered surrender shall be appended to the Complaint charging the <br /> named defendant with domestic violence, a violation of Lakewood Codified Ordinance <br /> Section 537.14 or Ohio Revised Code Section 2919.25. <br /> <br />(c) Any defendant aggrieved by an order of surrender as described in paragraph (a) may <br /> petition the Court for a review of such action, and such petition shall be heard no later <br /> than ten (10) Court business days after the receipt of the notice of the petition by the <br /> court. Upon the filing of an affidavit by the defendant that a firearm, rifle, shotgun, <br /> deadly weapon or ammunition is required in the performance of the defendant's <br /> employment, and upon a request for an expedited hearing, the Court shall order said <br /> hearing within two (2) business days of receipt of such affidavit and request but only <br /> on the issue of surrender and suspension pursuant to this section. <br /> <br />(d) A surrender order issued pursuant to this section shall continue until otherwise <br /> ordered by the Court. Any item not lawfully reclaimed by its owner within ninety (90) <br /> days after a surrender order has been vacated shall be confiscated pursuant to <br /> Lakewex~d Codified Ordinance Section 549.29. <br /> <br />(e) Any violation of such orders shall be punishable by a misdemeanor of the firsi degree. <br /> <br />SECTION 549.27 FAILURE TO SECURE WEAPONS; MINORS AND <br />INCOMPETENT PERSONS <br /> <br />All firearms and deadly weapons mtrst be secured in a manner which prohibits the <br />accessibility, acquisition and/or use of such item by any minor or incompetent person. <br /> <br />Firearms furnished to a person under age eit~hteen (lO) must be in accordance with <br />Ohio Revised Code Section 2923.21. <br /> <br />(c) Any person who owns or possesses a firearm and/or deadly weapon and fails ro comply <br /> with parat~raph (a) is guilty of a misdemeanor of thc first dc,.:rec. <br /> <br /> <br />
