ARTICLE VII <br /> <br />DAMAGE, DESTRUCTION AND CONDEMNATION <br /> <br /> · Section 7.1. Damage and Destruction. In the event the Existing Facilities along <br />with any Improvements are damaged to the extent or destroyed, both as described in Section <br />5.11 of the Senior Indenture, the Lessee may request the City to call the Bonds for redemption <br />as provided in that Section and if the City does not within thirty (30) days of the receipt of such <br />request commence the proceedings for redemption of the Bonds the Lessee may cancel this Lease <br />pursuant to Section 12.1 hereof. <br /> <br /> Section 7.2. Eminent Domain. In the event all or a portion of the Leased Premises <br />is taken or damaged by the exercise of the power of eminent domain as described in Section <br />5.10 of the Senior Indenture, the Lessee may request the City to call the Bonds for redemption <br />as provided in that Section and if the City does not within thirty ~30) days of the receipt of such <br />request commence the proceedings for redemption of the Bonds the Lessee may cancel this Lease <br />pursuant to Section 12.1 hereof or, subject to the Trustees having moneys sufficient to effect <br />such redemption, may take on behalf of the City those actions necessary to be taken by the City <br />under the Indentures to accomplish such redemption and such actions when taken shall be the <br />actions of the City. <br /> <br /> Section 7.3. Damages to, Destruction of and Condemnation of Lessee-Owned <br />Properr~...
