Once the STB's approval of the Corn'ait Application has become <br /> effective, NS will promptly commence consmaction of the <br /> Cloggsville Connection projects, and NS will advance completion <br /> thereof with reasonable expedition in view of operating, <br /> engineering and other constraints, the projects' cost and <br /> complexity, and any need to obtain additional governmental <br /> approvals. <br /> <br /> 3. CTovemment Approvals. NS' commimaent to construct <br /> <br /> the Cloggsville Connection project and to so in accordance with <br /> the schedule detailed above is subject to the acquisition of any <br /> necessary federal, state and local regulatory, governmental, <br /> environmental and other permits, approvals and authorizations for <br /> the projects specified herein, including but not limited to any <br /> necessary and applicable STB approvals. <br /> <br /> B. Reroo~q of Trains from Nickel plate to Conrail Lines: NS agrees that <br />promptly upon completion of construction of the double connection at Vermilion, <br />NS will reroute approximately 10.6 trains per day from a Rochester, PA -- <br />Youngstown,, OH - Aslatabula, OH - Cleveland (Cloggsville) - Vermilion <br />muting through Cleveland and BRL via the NS Nickel Plate line (as provided in <br />the original Operating Plan), to a Rochester, PA -- Alliance, OH - White, OH - <br />Cleveland (CP 181) - Berea, OH - Vermilion routing through Cleveland via <br />Conrail lines to be operated by NS post-Transaction. Once this rerouting is <br />accomplished, NS projects that average daily freight train traffic on the Nickel <br /> <br /> <br />
