<br />Leased Premises or tile furnishings and equipment remaining therein" Lessee ag1'eèS to defend <br />such claims.with counsel that meets the approval of those parties indemnifiedhereÌn" The <br />provisions herein shall not b_c applicable in the event that the loss, cost. judgment or expense <br />results from the conduct of the Lessor or Lessor's agents, employees, visitors or invHees. <br /> <br />18 TERMINATION: <br /> <br />181 DEFAULT: The following shall be deemed an event of default on the part ofthe <br />Lessee: <br /> <br />a) Failure to comply with section 5 or 6 of this Agreem.ent under any circumstances; <br /> <br />b) Failure to comply witl, any other provisions of this Lease for thirty (30) days after <br />written notice thereof by Lessor; provided that if the nature of such Default is such <br />that the same cannot reasonably be cured within such period, Lessee shall not be <br />deemed to be in Default if Le,see shall within such period commence to eurc such <br />Default and thereafter diligently prosecute the same to compJetion; <br /> <br />e) Abandonment oflhe Leased Premises by the Lessce, by leaving the Leased <br />Premises (,11' a substantial portion thereof, vacant or deserted to! a period of over <br />tlúrty (30) consecutive days; <br /> <br />d) The fa:ih~re of Lessee to remove any Hens or encumbrances placed on tilc Leased <br />Premises as a. result of obligations or debts of the Lessee within thirty (30) dllY:-¡ of <br />the filing of said lien or encumbrance; <br /> <br />18.2 TERMINATION: Tn addition to tennination as a result oJ default as described <br />above, Lessör Or Lessee may terminate this Lease Agreement without further <br />obligation upon nincty (90) days advance written notice issued in accordance with <br />the notice provisiQns as set forth in paragraph 26 herein. All rights and duties <br />under this Lease agreement shall terminate after the ninety (90) day nótice period <br />has expired, with exception of ,Lessee's obligation to pay any rent which may be <br />due through the tenllination date, all reimbursable expenses up to the termination <br />d.ate which are payable to Lessor in accordance with the terms and conditÌons of <br />th1s Lease Agreement and Lessee's obligation to Lessor under this Lease <br />Agreement <br /> <br />Upon an occurrence of an event of defa:ult, Lessor. in addition to any remedies províded <br />by law.. may take such action, at Lessee's expense, as may be necessary to cure the defau1t, the <br />cost of which shall be payable by Lessee on demand. Additionally, upon an OCCUITence or <br />default or termination Lessor may reenter and retake possession of the Leased Premises, with or <br />without termination of the Lease ìn tho case of default. Lessor may at any time relet the Leased <br />Premises, or any part thereof, upon such conditions and at such rental as Lessor may deem <br /> <br />5 <br />
