761.04 DUTIES OF INSPECTOR <br />The Inspector shall have chazge of the enforcement of all ordinances pertaining <br />to smoke regulation and the prepazation and execution of educational plans for <br />securing the cooperation of the public in the reduction of the emission of smoke. <br />In addition, he shall exercise general supervision over the Division of Smoke In- <br />spection and Regulation. <br />He shall be charged with the examination of all applications and plans submit- <br />ted, the inspection of the installations, according to the plans approved, of all <br />healing, power and fuel and refuse-burning equipment, and the prevenfion and <br />abatement of smoke, fumes and fly-ash, as more fully detailed in this chapter. <br />761.05 STANDARD OF MEASUREMENT. <br />The Ringehnann Chart, as now published and used by the United States Bureau <br />of Mines, which Chart is made a part hereof by reference, shall constitute the <br />standard for and shall be used for the purpose of grading the density of smoke in <br />the enforcement of the provisions of this chapter,. <br />761.06 EMISSION OF DENSE SMOKE. <br />The emission of dense smoke within the City from the smokestack of any boat, <br />tug, roller, demck, pile driver, taz kettle or other similaz machine or contdyance, <br />or from any open fire, or from the smokestack or chimney of any building, <br />roundhouse or premises, except for a period of or periods aggregating six min- <br />utes or less in any one hour at a rime when the firebox is being cleaned out or a <br />new fue is being built therein, or from the stack of any locomotive for a period <br />in excess of one continuous minute after such locomotive is in or ready for ser- <br />vice, of a density equal to or greater than No 2 smoke, as defined by the <br />Ringelmann Chart,zs prohibited and is hereby declazed to be a nuisance and <br />may be summarily abated by the Inspector or by anyone whom he may duly au- <br />thorize for such purpose. Such abatement maybe in addition to the fine provided <br />for in Section 761.99. <br />761.07 EMISSION OF SOOT, GASES AND ASH. <br />No person shall cause, permit or allow to escape from any smokestack or chim- <br />ney into the open air, abnormal quantities of soot, cinders, noxious acids, fumes, <br />gases or burnt paper. <br />761.08 FUEL-BURNING DEVICES. <br />Excepting fuel-burning devices used for the production of heat in buildings used <br />exclusively for private residence purposes in which the number of families oc- <br />cupying apartments is less than four, to which buildings and the fuel-burning <br />devices used therein this section shall not apply. No person shall install or use <br />any fuel-burning device of the surface burning type for the production and gen- <br />eration of heat and power, or either of them, unless the fuel used in such device <br />is a smokeless solid fuel as hereinafter defined. <br />"Smokeless solid fuel", for the purpose of this chapter, means and shall be con- <br />sidered as afuel the volatile content of which is twenty-three percent or less on a <br />dry basis, provided, however, that if a fuel contains volatile matter in excess of <br />twenty-three percent on a dry basis, it shall be acceptable under the terms of this <br />chapter if it meets the same standards in regazd to smoke production as that of a <br />
