11. Program Income. The Grantee agrees to comply with Federal {45 CFR, Sec <br />74.40), State (ODA Policy and Procedure section 409) and Agency policy for <br />procedures relating to and the accounting for program 'income. The Grantee agrees <br />as follows, <br /> <br />A. Each older person served under ~his contract must be given ~he <br /> opportunity to contribute voluntarily to the service. The terms <br /> "charge" and "fee" must not be used when presenting this opportunity to <br /> contribute. <br /> <br /> B. No person sixty (60) years of age or older shall be denied service under <br /> this agreement because of that person's abili ty or decision to <br /> contribute or not to contribute to the service. <br /> <br /> 12. Grantee Audits. The Grantee agrees to require that Title III program <br /> f~nds are included in any periodic general audit of' the Grantee's financial records <br /> <br />completed by any independent audit firm. The Grantee further agrees to provide <br />the Agency with a copy of the report of any audit of the Grantee covering the <br />period during which the service(s) is provided within ten (i0) calendar days after <br />such report is received by the Grantee. The Grantee agrees to respond in writing <br />to the Agency within ten (10) calendar days of. a written receipt of any audit <br />findings pertaining to the Grantee's Title III service(s) with a plan to resolve <br />said findings. If said response is not received by the Agency within the said ten <br />· [10; calendar days, the Agency may suspend reimbursement of ali or part of the cost <br />of the service(s) until corrective action acceptable to the Agency is implemented. <br /> <br /> 13. Conditions of the Grant. The Agency may suspend or terminate the grant <br />and/or any reimbursement in whole or in part due under this Agreement for failure <br />to comply with the terms of this Agreement. <br /> <br />Page 7 of 10 <br /> <br /> <br />
