COMMITTEE F TH_= ',~'H;~' 9/$~ 98. <br /> <br />ORDINANCE NO.4 <br /> <br />AN ORDINANCE REPEALING THE MONTHLY WATER CUSTOMER SERVICE <br />CHARGE CONTAINED IN SECTION 915.02 OF THE CODIFIED ORDINANCES OF <br />THE CITY OF LA.K.EWOOD AND DECLARING AN EMERGENCY <br /> <br /> Whereas. a petition for the proposed Ordinance repealing Section 915.02 of the <br />Codified Ordinances of the City of Lakewood. Customer Service Charge has been <br />submitted: <br /> <br /> Whereas. it has been determined that said petition contains sufficiem number of <br />valid signatures; <br /> <br /> Whereas. the committee of the petitioners has requested that the proposed <br />Ordinance be submitted to the electors for their a~proval; <br /> <br /> Whereas, it is the duty of Council to forthwith make provisions for the submission <br />of said proposed Ordinance to the electorate oftbe City of Lakewood at an election to be <br />held pursuant to law; <br /> <br /> Now, Therefore, be it ordained by the Council of the City of Lakewood, <br />Cuyahoga Count5'., Ohio; <br /> <br /> Section 1. There shall be submitted to the electors of the City of Lakewood al <br />a municipal election to be held, as is provided by law, the proposed Ordinance repealing <br />Section 915.02 of the Codified Ordinances oftbe City of Lakewood, Customer Sero, ice <br />Charge. <br /> <br /> Section 2. That Section 915.02 oft. he Codified Ordinances of the City of <br />Lakewood. Customer Service Om'ge as stated below shall be repealed in its entirety: <br /> <br />91 5.02 CUSTOMER SERVICE CHARGE <br /> <br />~) <br /> <br />There is hereby established a monthly water-customer service charge to be <br />charged by the Lakewood Division of Water and Wastewater Collections. <br /> <br />The Director of Public Works shall annually set the monthly water customer <br />s~r~ice charge no later than December I$ of each year to be effective January. I of <br />the following year, such customer service charge shall be the budgeted <br />~xpendirares of the Water M~ters Section of the Division of Water and <br />Wastewaler Collections divided by the total number of water bulls issued <br />annually. <br /> <br /> Section 3. The ballots for said election shall, at the top thereof, be entitled <br />"Proposed Ordinance Ballot" and the question to be submitted on said Ballot shall be in <br />the words following: "An Ordinance Repealing the Monthly Water Customer Service <br />Charge contained in Section 915.02 of the Codified Ordinances of the City of <br />Lakewood." In the appropriate position below shall be placed the following, "For the <br />Ordinance" and "Against the Ordinance". <br /> <br /> Section 4. The Clerk of Council is directed to certify, a copy of this ordinance <br />to the Board of Elections of Cayahoga County, and to take all further acnon required by <br />law relative to the submission of said proposed Ordinance at said election. <br /> <br /> EXHIBIT A <br />1 <br /> <br /> <br />
