AGREEMENT - EXHIBIT A <br /> <br />1. The Board shall have and hereby agrees to assume and continue full and <br /> complete maintenance and operation of the pools at Madison and Lakewood <br /> Parks. Operation and maintenance as used in this agreement shall mean <br /> complete control of all phases of operation of the pools and all maintenance <br /> by way of cleaning or otherwise be reasonably necessary and incidental to <br /> operation of such pools. It is not intended to include alterations or repairs. <br /> <br />2. The City agrees to furnish and keep in good repair all equipment, fixtures and <br /> facilities. The City shall make all repairs as may be necessary to the operation <br /> of the pools as quickly as possible and be totally responsible for the <br /> preparation and closing o f the pools. <br /> <br />3. The City agrees to pay all utilities associated with the pool operation. <br /> <br />4. The City agrees to meet all Health Department requirements and provide all <br /> cleaning products, paper products, first aid supplies and chemicals as may be <br /> necessary for operation of the swimming pools. <br /> <br />5. The Board agrees to maintain the pools and pool areas in a clean and sanitary <br /> condition. <br /> <br />6. The City will maintain a staffof at least one full-time person under the <br /> direction of the Parks Operations Manager and the Director of Public Works <br /> to address repairs at the pools during the entire swimming season. <br /> <br />7. The Board agrees to request repairs and service desired at the pools <br /> immediately in writing on a form agreeable to both parties. These forms will <br /> be forwarded to the Director of Public Works. <br /> <br />8. The City, at its sole cost, shall obtain and maintain at all times during the <br /> continuation of this agreement a commercial liability policy in the name of the <br /> Board, insuring the Board against any and all claims, liabilities and expenses <br /> arising out of the Board's operation of the pools. Such policy shall have <br /> limits of liability of not less than $2,000,000 per occurrence and not less than <br /> $5,000,000 annual aggregate. Deductible amounts, if any, shall be paid by the <br /> City when due. The original of such policy shall be delivered to and held by <br /> the Board. <br /> <br />9. The Board and City staffs, responsible for the pool operations, will meet <br /> monthly for the two months prior to commencement of pool operation, during <br /> the swimming season and two months after the swimming season to discuss <br /> issues related to pool operations. The final meeting of the year will be in the <br /> month of November. The Board shall supply a final financial statement <br /> including: <br /> <br /> <br />
