Environmental Laws: Any federal, state or local laws, ordinances or regulations relating to <br />industrial hygiene or to the environmental conditions, including without limitation, the <br />Comprehensive Environmental Response, Compensation and Liability Act of 1980, as amended, <br />the Hazardous Materials Transportation Act, the Resource Conservation and Recovery Act, the <br />Hazardous Substances Account Act, the Hazardous Substances Act and the Underground Tank <br />Act of 1984, and the Toxic Substances Control Act (TSCA). <br />Grantor: County of Cuyahoga County, Ohio, a county and political subdivision of the State of <br />Ohio, or successor governing entity. <br />Grant: The Grant to be made pursuant to this Agreement. <br />Grant Amount: An amount not to exceed the lesser of (i) One Hundred Thousand Dollars U.S. <br />($100,000.00); (ii) one hundred percent (100 %) of the Eligible Costs; or (iii) so much of (i) or (ii) <br />as may be advanced from time to time to. or for the benefit of the Subgrantee subject to the terms <br />and conditions of this Agreement. <br />Grant Application: The Grant application submitted to Grantor by Subgrantee in connection with <br />the Grant, together with all attachments, supporting documentation, amendments and supplements <br />thereto as approved by Grantor. <br />Grant Disbursement Date: The date of the first Disbursement of the Grant Proceeds. <br />Grant Documents: This Agreement and the documents attached to or referred to in this Agreement. <br />Grant Expenses: All interest, charges, costs and expenses incurred by Grantor in connection with <br />the Grant, including but not limited to (ii) any amounts required to be paid by Subgrantee under <br />this Agreement or any of the other Grant Documents after the occurrence of a Default hereunder, <br />(iii) and any repayments of the Grant Amount the Grantor is required to make to the USEPA as a <br />result of a Default. <br />Grant Proceeds: Any and all amounts advanced as part of the Grant, whether advanced directly to <br />Subgrantee or other parties designated by Grantor. <br />Ohio Voluntary Action Program: the environmental clean up program established under ORC <br />Chapter 3746, and the regulations set forth in OAC 3745- 300 -01 through 3745- 300 -014 <br />PCBs: Polychlorinated biphenyls as regulated under the Toxic Substances Control Act. <br />Phase I Environmental Site Assessment: A Phase I Environmental Site Assessment conforming <br />to the requirements of and completed in accordance with American Society for Testing and <br />Materials E 1527 -05 (Standard Practice for Environmental Site Assessments: Phase I <br />Environmental Site Assessment Process), together with a Limited Pre- renovation Asbestos <br />25 <br />
