9 <br />RENT <br />3.1 Base Rent: Tenant shall pay to Landlord at Landlord's office or at such other place <br />as Landlord may from time to time designate In writing, as Base Rent for the Term, <br />annual Base Rent as follows; <br />Months <br />Annual Base Rent <br />Monthly Installment <br />Effective Date — Last day <br />of the 240 full calendar <br />month thereafter <br />$71,544.00 <br />$5,962.00 <br />25th -36th calendar month <br />$84,552.00 <br />$7,046.00 <br />37'h — 48th calendar month <br />$87,088.56 <br />$7,257.38 <br />49u'— 60th calendar month <br />$89,701.22 <br />$7,475.10 <br />Each monthly payment shall be due in advance on the first day of each month of the <br />Term, beginning on the date the Term commences, and continuing on the first day of <br />each calendar month thereafter. Base Rent for any partial month shall be prorated at <br />the rate of 1/30'" of the monthly rent for each day. Notwithstanding the above, <br />Tenant may defer the payment of the first two (2) months Base Rent provided it pays <br />such amount no later than the beginning of the twelfth (12th) calendar month of the <br />Term. <br />31 Service Charge for Late Payment: if any installment of Base Rent, additional rent or <br />any other charge provided for herein, or any part thereof, is not paid within ten (10) <br />days after its due date, it shall be subject to a service charge of one and one -half <br />percent (1 -1/2 %) of the unpaid amount due for each month or fraction thereof, or <br />such lesser amounts as may be the maximum amount permitted by law, until paid. <br />3.3 Rentals: The term "Rentals" as used in this Lease shall include all Base Rent <br />payable pursuant to paragraph 3.1 above and any additional rent payable pursuant to <br />the terms of this Lease. All Rentals shall be paid to Landlord at the address to which <br />notices to Landlord are given, as specified in Section 23 below. <br />4. USE OF PREMISES <br />4.1 In General: Tenant shall use and occupy the Premises for a Child Care Center only <br />and for no other purpose; provided, however, that such use may include parent <br />meetings and fund - raising events so long as Landlord receives at least 72 hours prior <br />written notice of such parent meetings and /or fund - raising events. Tenant shall <br />maintain the Premises in a safe and careful manner, conforming to good <br />housekeeping practices, without permitting any nuisance or committing any waste or <br />exceeding floor load capacities. Tenant shall conform to and obey all laws, <br />ordinances, rules, regulations, requirements and orders of all governmental bodies or <br />authorities which have jurisdiction over its use of the Premises. Further, Tenant <br />agrees not to use the Premises in any manner deemed specially hazardous because <br />of fire risk or otherwise. No volatile or toxic substances or nuclear or radio - active <br />materials shall be brought or kept on the Premises or common areas, or stored <br />
