a) To be reimbursed, Sub - Grantee must submit a written request for <br />reimbursement and attach appropriate paperwork to Identify the Vehicle, demonstrate <br />that the Vehicle was purchased by Sub- Grantee, and identify the purchase price actually <br />paid by Sub - Grantee for the Vehicle. <br />(1) Sub- Grantee must purchase the Vehicle and submit to Cleveland all <br />necessary documentation no later than June 25, 2017. Upon Sub - Grantee's failure to do <br />so, Cleveland may Immediately cancel this Agreement without any resultant financial <br />obligation to reimburse Sub - Grantee, whether or not Sub - Grantee has or does purchase <br />the Vehicle before or after that date. <br />b) Cleveland shall reimburse Sub - Grantee within forty -five (45) days of receipt <br />of Sub - Grantee's request and the appropriate paperwork. <br />c) If the Grant funding Is cancelled for any reason or reimbursement for Sub - <br />Grantee's purchase of the Vehicle is denied by the Grantor, Cleveland shall not be liable <br />for any costs or expenses Incurred by Sub - Grantee in connection with the Vehicle. <br />3. Qwnership and Use of Vehicle <br />a) Sub - Grantee shall hold title to and sole ownership of the Vehicle purchased <br />under this Agreement and shall be solely responsible for Its use, maintenance, and any <br />other expense, fee, or responsibility attributable to the Vehicle and Sub - Grantee's use of <br />It. <br />b) The Vehicle is Intended for use by, and shall be used by, Sub - Grantee's law <br />enforcement personnel only for the purpose of participating in NEOLEFI" activities for a <br />minimum period of three (3) years from date of purchase. This requirement shall survive <br />the termination of this Agreement for any reason. <br />c) Other than the reimbursement amount stated in section I above of this <br />Agreement, Cleveland shall have no further financial or any other responsibility for the <br />Vehicle or Its use by Sub - Grantee's Police Department. <br />4. Compliance with Grant and Progrgm Re u rements <br />Sub - Grantee shall comply with all applicable Grant funding requirements and <br />conditions Imposed on Cleveland by the Grantor. <br />5. Term <br />The Term of this Agreement shall commence on the date first above entered and <br />terminate three years from the date of purchase of the vehicle by Sub - Grantee. <br />6. Procurement <br />a. Sub - Grantee's Procedures In purchasing the Vehicle, Sub - Grantee shall use <br />Its own procurement procedures which reflect applicable state and local laws and <br />regulations. <br />E <br />
