Ordinance 12-2021 recommended for adoption. <br /> ORDINANCE 08-2021 - AN ORDINANCE to take effect immediately provided it <br /> receives the vote of at least two thirds of the members of Council, or otherwise to take <br /> effect at the earliest period allowed by law, amending Section 103.02 Definitions and <br /> Chapter 1153 Fences of the Codified Ordinances of the City of Lakewood in order to <br /> clarify fence installation requirements within the City of Lakewood. <br /> The Committee was referred to a substitute version of the ordinance which was emailed. <br /> Assistant Building Commissioner Parmelee explained that the ordinance re-writes the fence code <br /> to clear up confusion and to make it more accessible to the public. Some things that were added <br /> or clarified include: <br /> • Matching styles of fences are required <br /> • If adding a new fence, a neighbor must have five days' notice <br /> • Corner lot fences treated differently to protect sight lines <br /> The Committee discussed with Building officials how other communities regulate fences. <br /> Commissioner Meyers remarked that the ordinance will provide a better roadmap for residents <br /> who are looking to install a fence. Most language from the original ordinance was maintained, <br /> with some clarification added for areas that were especially difficult to interpret, such as the <br /> regulations around corner lots. New fences are no longer allowed to be put up right against a <br /> sidewalk or driveway to protect sight lines. <br /> It was noted that the Ordinance needed to be referred to the Planning Commission because it <br /> amends the Zoning Code. <br /> A motion was made and seconded to favorably refer substitute Ordinance 08-2021 to the <br /> Planning Commission. <br /> It was clarified that the ordinance grandfathers in existing structures and that the Building <br /> Department does not generally "go after"fences that are already in place. <br /> A roll call vote was taken as follows on the motion to favorably refer Ordinance 08-2021 to <br /> Planning Commission: <br /> Yeas: Shachner, Kepple, Rader <br /> Nays: none <br /> Motion adopted. Ordinance 08-2021 favorably referred to Planning Commission. <br /> 3 <br />
