2. RESOLUTION 2022-56- A RESOLUTION to take effect immediately provided it <br /> receives the affirmative vote of at least two thirds of the members of Council, or <br /> otherwise to take effect and be in force after the earliest period allowed by law, <br /> authorizing the Mayor of the City of Lakewood and Director of Law to make an offer <br /> for the purchase of the property located at 12984 Lake Avenue, Lakewood, Ohio (PPN <br /> 312-08-017), and, if the offer is accepted, to negotiate and execute all documents <br /> necessary to effectuate the purchase and sale. (Referred to COW 11121122) (pg. 1) <br /> Motion by President Litten, seconded by Vice President Kepple to adopt Resolution 2022-56. <br /> Discussion: Director Leininger noted that the city had been presented with an opportunity to <br /> put in an offer for 12984 Lake Ave. The property is located closely to CSO 59, which is a sewer <br /> overflow that connects with the city's wastewater interceptor near the Carlyle building. As part <br /> of the IWWIP, the city has committed to the EPA that it would build storage tanks near CSO 59 <br /> and CSO 52 to limit sewer overflows. While the Cove Church property was purchased with <br /> intent to install storage tanks onsite, this property presents as a much closer one to CSO 59. If <br /> successful, the city is interested in preserving the historic home at 12984 Lake Ave. Questioning <br /> from councilmembers prompted Director Leininger to state that there would be approximately a <br /> $3 million savings to the city in infrastructure costs if the 12984 Lake Ave. site was available to <br /> be used. The funds to purchase the site would come from American Rescue Plan Act dollars that <br /> were initially slated for sewer infrastructure. City staff have been successful in acquiring <br /> grants, which frees up funding for this venture. Councilmembers noted their support for the <br /> historic preservation of the home and the cost savings for the sewer project. <br /> On the motion: All in favor. Motion passed. Resolution 2022-56 was adopted. <br /> 3. ORDINANCE 12-2021A -AN ORDINANCE to take effect immediately provided it <br /> receives the vote of at least two thirds of the members of Council, or otherwise to take <br /> effect at the earliest period allowed by law, to amend S. Ord. 12-2021, adopted March <br /> 15, 2021, to remove the sunset date of the original legislation and permanently <br /> expanding rental rights within the City of Lakewood by allowing renters who tender <br /> their full rent plus any additional late fees and court costs,prior to an eviction hearing to <br /> avoid eviction for late payment of rent and setting reasonable late fees that a landlord <br /> may charge a tenant. (Is' read and referred to HPD 1117122; 2"'reading 11121122) (pg. <br /> 3) <br /> Motion by President Litten, seconded by Vice President Kepple to substitute Ordinance 12- <br /> 2021A. <br /> Discussion: Director Vargo characterized the changes made, which make the provision <br /> permanent and included the definition of"tender" to account for public vouchers. <br /> Councilmembers discussed whether the ordinance approves the use of only emergency rental <br /> assistance dollars previously appropriated or whether the language indicated that source of <br /> income protections would be in effect in all cases.
