Motion passed. <br /> ***NEW BUSINESS*** <br /> 5. Communication from Councilmember Baker regarding resolution of necessity and <br /> determination to proceed and assessing ordinance for the Shoreline Special Improvement <br /> District, Inc. (pg. 5) <br /> Motion by President Litten,seconded by Vice President Kepple to receive and file communication. <br /> Discussion: Law Director Vargo spoke about a cooperative agreement that would set the City's <br /> responsibilities for the assessment of thirdparty claims. The provision would extend thirdparty <br /> claims against the City, as the City would seek indemnity. Law Director Vargo expressed that the <br /> Administration would recommend passage of the Ordinance. <br /> Kevin Butler, 17517 Lakewood His Mr. Butler expressed his appreciation to Council and the <br /> Administration for putting time into the consideration of the legislation. With these last two pieces <br /> of legislation pending approval, Mr. Butler expressed that the SID would honor the City's <br /> agreement with respect to the money that comes in. <br /> Linda Springer, 1031 Nicholson Rd Ms. Springer spoke about the erosion control projects she <br /> is working on, and she expressed the urgency of the project to be finished by the time the weather <br /> gets inclement in the fall. She explained that the legislation will make it easier to span out the <br /> payments for the project. <br /> Councilmember Bullock expressed his support for the adoption of Resolution 2023-14. He spoke <br /> about the City's authority to collect and manage revenue, and he noted that lowering the cost of <br /> the maintenance process for shoreline property owners is worth consideration. <br /> On the motion: All in favor. Motion passed. <br /> 6. RESOLUTION 2023-14 - A RESOLUTION to take effect immediately provided it <br /> receives the affirmative vote of at least two thirds of the members of Council, or otherwise <br /> to take effect at the earliest period allowed by law, declaring it necessary and determining <br /> to proceed with acquiring, constructing, installing, equipping, improving, maintaining and <br /> repairing improvements necessary for making improvements to abate erosion along <br /> properties within the City included within the Lakewood Shoreline Special Improvement <br /> 3 <br />
