(pg. 123) <br /> <br />Motion made by President Litten to refer the ordinance to the finance committee, seconded by <br />Councilmember Bullock. All in favor, motion passed. <br /> <br />36. Communication from Human Resources Director Dillinger regarding the amendment of <br />section 149.14 Hospitalization Coverage for Employees of the Administrative Code. <br />(pg. 128) <br /> <br />Motion made by President Litten to receive and file the communication, seconded by <br />Councilmember Bullock. All in favor, motion passed. <br /> <br />37. ORDINANCE 38-2023 - AN ORDINANCE to take effect immediately provided it <br />receives the affirmative vote ofat least five members of Council, amending Section 149.14 <br />of the Lakewood Codified Ordinances to remove medical coverage for same sex partners <br />in light of the legalization of same sex marriage in the State of Ohio. (pg. 129) <br /> <br />Motion made by President Litten to suspend the rules to consider adoption on first reading, <br />seconded by Councilmember Bullock. <br /> <br />A roll call voted was conducted as follows: <br /> <br />Yea: Baker, Bullock, Litten, Marx, Rader, Shachner <br />Nay: none <br /> <br />A motion was made by President Litten to adopt Ordinance 38-2023 and seconded by <br />Councilmember Bullock. <br /> <br />Councilmember Shachner stated that same sex marriage is only legal because of a U.S. Supreme <br />Court decision, and he expressed concern of what would happen if that decision was ever <br />overturned. Director Dillinger replied that the administration would like the language to match the <br />current practice. She said the no matter who is married (same sex or opposite sex) they are required <br />to submit the same documentation, and if the Supreme Court ruling were to be overturned the City <br />would address that at that time. She also clarified that the City does not currently recognize <br />domestic partners or common law relationships regardless of whether they are same sex or <br />opposite sex couples. <br /> <br />Councilmember Bullock expressed similar concerns to Councilmember Shachner and suggested <br />outside legal counsel might be appropriate to make sure this does not have any unintended impacts. <br />Director Dillinger stated that this is a common practice standard in the field of Human Resources. <br />She clarified that she cannot speak to why the language was not updated when the change <br />occurred, but she caught this when she was reviewing documents in preparation for the upcoming <br />charter review.
