<br />sor shall be appointed for a term of five
<br />years. Vacancies shall be filled for an unex-
<br />pired term in the manner in which the orig-
<br />inal appointments are required to be made.
<br />Continued absence of any member from reg-
<br />ular meetings of this Board shall render any
<br />such member liable to immediate removal
<br />from office.
<br />1513.03 Quorum.
<br />Three members of the Board shall con-
<br />stitute aquorum. In varying the application
<br />of any provision of this Dwelling House Code
<br />or in modifying an order of the Building
<br />Official, affirmative votes of three members
<br />shall be required.
<br />1513.04 Disqualification.
<br />No member of the Board shall pass upon
<br />any question in which he has a financial or
<br />personal interest. On such appeals or ques-
<br />tions in which a member is disqualified or
<br />asks to be excused, the Mayor shall appoint
<br />an alternate to fill the temporary vacancy,
<br />1513.05 Compensation.
<br />The Council shall, at the start of each year,
<br />set the compensation of the members of the
<br />Board of Building Code Appeals for the time
<br />served at Board meetings.
<br />1513.06 Powers.
<br />The Board of Building Code Appeals shall
<br />have the power, subject to the limitations
<br />and in the manner set forth in this Dwelling
<br />House Code, to:
<br />i. Affirm or reverse, in whole or in part,
<br />or modify, any decision of the Building Of-
<br />ficial interpreting the provisions of this
<br />Dwelling House Code;
<br />ii. Vary the application of any provision
<br />of this Dwelling House Code to any par-
<br />ticular case, when, in its opinion, enforce-
<br />ment thereof would do manifest injustice,
<br />would be contrary to the spirit and the pur-
<br />pose of this Dwelling House Cade or the
<br />public interest;
<br />iii. Determine if any material or method of
<br />construction may be used, even though not
<br />specifically authorized by this Dwelling
<br />House Code, and specify the manner in
<br />which such materials and methods shall be
<br />used;
<br />iv, Determine any requirement for the
<br />strength or stability of an existing or pro-
<br />posed building or structure, or for the
<br />safety or health of the occupants thereof, not
<br />specifically covered by this Dwelling House
<br />Code, or not readily interpretable from the
<br />provisions of this Dwelling House Code; -
<br />v. Determine whether any proposed rule
<br />of the Building Official supplements or aids
<br />in the interpretation of the requirements of
<br />this Dwelling House Code and is consistent
<br />therewith, and to affirm, amend, modify or
<br />nullify any such proposed rule.
<br />vi. Establish rules and regulations, condi-
<br />tions and qualifications for the registration,
<br />licensing or certification of qualification of
<br />any person performing work or providing
<br />services under this Dwelling House Code.
<br />vii. Report and recommend to the Council
<br />any amendment, deletion or addition to this
<br />Dwelling House Code.
<br />1513.07 Meetings and records.
<br />Meetings of the Board shall beheld at the
<br />call of the chairman and at such other times
<br />as the Board may determine. All hearings
<br />before the Board shall be open to the public.
<br />The Board shall keep minutes of its pro-
<br />ceedings, showing the vote of each member
<br />upon every question, or if absent or failing
<br />to vote, indicating such facts, and shall also
<br />keep records of its examinations and other
<br />official actions. Such minutes and such rec-
<br />ordsshall bepublic records.
<br />1.513.08 Procedure.
<br />The Board shall establish rules and reg-
<br />ulations for its own procedure not incon-
<br />sistent with the provisions of this Dwelling
<br />House Code. It shall also establish a sched-
<br />ule of fees that may be required for filing
<br />designated types of appeals. The Board mem-
<br />bers shall annually, by majority vote, select
<br />one of the members to serve as chairman,
<br />who shall hold office for a term of one year
<br />or until his successor is elected and qualified.
<br />1513.09 Reports.
<br />The Board shall submit a report to the
<br />Mayor and Council not less than once a year
<br />covering the meetings and a summary of the
<br />decisions of the Board during the preceding,
<br />period, with recommendations as to desirable
<br />amendments to this Dwelling House Code or
<br />the Building Official's rules and regulations.
<br />A copy of such report shall be sent to the
<br />Regional Board of Building Standards.
<br />1513.10 Alternative Board.
<br />In lieu of the Board created with the
<br />duties and powers set forth in Sections
<br />1513.01 through 1513.09, the Mayor may,
<br />with the consent of the Council, designate
<br />any Administrative Board or Commission
<br />created by the charter or any ordinance of
<br />this Municipality to carry out and perform
<br />the duties charged upon the Board of Build-

<br />drainage system through an air-gap serving
<br />the individual fixtures, devices, appliances
<br />or apparatus:
<br />i. A refrigerator, ice-box, steam table or
<br />other receptacle, appliance, device or appa-
<br />ratus which is used for the storage, prepara-
<br />tion or processing of food or drink.
<br />ii. An appliance, device or apparatus using
<br />water as a cooling or heating medium.
<br />iii. Appliances, devices or apparatus such
<br />as sterilizers or water stills.
<br />iv. Water treatment devices such as filters
<br />or softeners and water operated devices; and
<br />drains, overflows or vents from water-supply
<br />systems.
<br />1593.87 Permissible indirect waste.
<br />(a) Laundry trays. The waste from a
<br />laundry tray or trays may discharge into a
<br />trapped floor drain.
<br />(b) Scum gutters and surface drains
<br />around swimming pools. Scum gutters, scum
<br />gutter drains and floor drains serving walks
<br />around swimming pools may be installed
<br />with indirect waste.
<br />(c) Bar, counter or laboratory sinks.
<br />Small bar, counter, laboratory sinks and
<br />other small fixtures, determined by the
<br />Building Official to be of similar type, maybe
<br />installed with indirect waste where direct
<br />waste connections are impracticable and in-
<br />direct waste connections are specifically ap-
<br />proved by the Building Official. Where in-
<br />direct wastes are approved, such fixtures
<br />shall be trapped but no individual vent will
<br />be required.
<br />(d) Clear water wastes. Clear water
<br />wastes, water lifts, expansion tanks, cooling
<br />jackets, sprinkler systems, drip or overflow
<br />pans or similar devices which wastes clear
<br />water only may discharge onto a roof, into
<br />a sump, or into a trap or fixture.
<br />1593.88 Inspections and tests.
<br />(a) Request. It shall be the responsibility
<br />of the person, to whom the plumbing permit
<br />has been issued, to give 24 hours advance
<br />notice to the Building Official when plumb-
<br />ing work is ready for test or inspection.
<br />When proper notice has been given and the
<br />test or inspection has not been made, the
<br />work may proceed without waiting on such
<br />test or inspection, but no work shall be
<br />covered or concealed without specific au-
<br />thorization to do so from the Building Of-
<br />ficial.
<br />(b) Preliminary test. It shall be the re-
<br />sponsibility__of_ the person to whom-the
<br />plumbing permit has been issued to conduct
<br />a preliminary test in order to make certain

<br />that the work will stand the prescribed test
<br />before making the request required in sub-
<br />section (a) of this section.
<br />(c) Retesting and reinspection. If the
<br />Building Official finds that the work does
<br />not pass the test or inspection, the person
<br />to whom the plumbing permit has been is-
<br />sued shall be required to make the necessary
<br />corrections and the fork shall then be re-
<br />submittedfor test or inspection.
<br />1593.89 Material and labor for tests.
<br />The equipment, material, power and labor
<br />necessary for inspection or test shall be fur-
<br />nished by the person to whom the permit is
<br />issued.
<br />1593.90 Testing drainage and vent systems.
<br />The piping of drainage and vent systems
<br />shall be tested with water or air. After the
<br />plumbing fixtures have been set and their
<br />traps filled with water, the entire drainage
<br />system shall be submitted to a final inspec-
<br />tion. The Building Official may require the
<br />removal of cleanouts or plugs or unsealing
<br />of traps to ascertain whether the test medium
<br />has reached all parts of the system. Where
<br />there is reason to doubt conformity with the
<br />provisions of this chapter, the whole plumb-
<br />ing system shall be submitted to a smoke or
<br />peppermint test.
<br />1593.91 VOater test of drainage and vent
<br />systems.
<br />(a) Drainage and vent stacks and
<br />branches. The water test shall be applied to
<br />the drainage and vent system in its entirety
<br />or in sections. If applied to the entire
<br />system, all openings in the piping shall be
<br />tightly closed, except the highest opening,
<br />and the system filled with water to the
<br />point of overflow. If the system is tested
<br />in' sections, each opening shall be tightly
<br />plugged except the highest opening of the
<br />section under test, and each section shall
<br />be filled with water, but no section, except
<br />the building drain and building sewer and
<br />its connected yard and area drains, shall be
<br />tested with less than a 10-foot head of water.
<br />In testing successive sections above the
<br />building drain, at least the upper 10 feet of
<br />the next preceding section shall be retested
<br />so that no joint or pipe in the building, ex-
<br />cept the uppermost 10 feet of the system,
<br />shall have been submitted to a test of less
<br />than 10-foot head of water. The water shall
<br />be kept in the system, or in the portion un-
<br />der test, far at least 15 minutes before in-- -
<br />spection starts. The system shall be water
<br />tight.
