?A WHEREAS, on December 1, 1984, the exchange of sezvices providedfor by said Agreement began, following final State certification of the Gates Mills jail facility; and WHEREAS, said Agreement has been continued on a month- to-month basis, with the consent and approval of both munici- palities, until such time as a permanent and continuing agree- ment could be formalized; and WHEREAS, the Mayors and Councils of the respective munici- palities have now reached agreement on the terms and provisions of such a permanent and continuing agreement. NOW, THEREFORE, it is mutually agreed by and between Mayfield Village, Ohio, as authorized by Resolution No. $641 , adopted by the Council of Mayfield Village on Ma?v 19 %b , and the Village of Gates Mills, as authorize by Ordinance No. 7-1 Rq , adopted by the Council of Gates Mills on as follows: 1. From and after the date of this Agreement, the Village of Gates Mills, in consideration for services to be provided by Mayfield Village as set forth hereinafter, agrees to receive, keep, board, maintain and, where appropriate, clothe all prisoners arrested by Mayfield Village or sentenced by the Lyndhurst Municipal Court for any violation of law occurring within the corporate limits of Mayfield Village. It shall be the responsibility of Mayfield Vil3.age to transport all prisoners to and from the jail facility of Gates Mills, whether such transportation is for purposes of confinement, appearance at Gourt or for any other reason. 2. In consideration of the foregoing, Mayfield Village agrees to provide to Gates Mills, ambulance and emergency medical service when called for by Gates Mills. It is mutually agreed by and between the parties hereto that all personnel . of Mayfield Village, while responding to a call for ambulance or emergency medical service by Gates Mills, shall be acting within the scope of their employment as fire personnel of Mayfield Village while enroute to, enroute from, and while acting within the territory of Gates Mills. 3. It is further agreed by and between the parties during the term of this Agreement, that Gates Mills will: (a) Rent or purchase and deliver a defibrillator for the exclusive use of the fire personnel of Mayfield Village in performing ambulance and emergency medical service runs, whether such runs are for the use and benefit of Mayfield Village, Gates Mills or pursuant to other mutual aid agreements. - 2-
