?A <br /> <br />WHEREAS, on December 1, 1984, the exchange of sezvices <br />providedfor by said Agreement began, following final State <br />certification of the Gates Mills jail facility; and <br />WHEREAS, said Agreement has been continued on a month- <br />to-month basis, with the consent and approval of both munici- <br />palities, until such time as a permanent and continuing agree- <br />ment could be formalized; and <br />WHEREAS, the Mayors and Councils of the respective munici- <br />palities have now reached agreement on the terms and provisions <br />of such a permanent and continuing agreement. <br />NOW, THEREFORE, it is mutually agreed by and between <br />Mayfield Village, Ohio, as authorized by Resolution No. <br />$641 , adopted by the Council of Mayfield Village <br />on Ma?v 19 %b , and the Village of Gates Mills, as <br />authorize by Ordinance No. 7-1 Rq , adopted by the <br />Council of Gates Mills on as follows: <br />1. From and after the date of this Agreement, the Village <br />of Gates Mills, in consideration for services to be provided <br />by Mayfield Village as set forth hereinafter, agrees to receive, <br />keep, board, maintain and, where appropriate, clothe all prisoners <br />arrested by Mayfield Village or sentenced by the Lyndhurst <br />Municipal Court for any violation of law occurring within <br />the corporate limits of Mayfield Village. It shall be the <br />responsibility of Mayfield Vil3.age to transport all prisoners <br />to and from the jail facility of Gates Mills, whether such <br />transportation is for purposes of confinement, appearance <br />at Gourt or for any other reason. <br />2. In consideration of the foregoing, Mayfield Village <br />agrees to provide to Gates Mills, ambulance and emergency <br />medical service when called for by Gates Mills. It is mutually <br />agreed by and between the parties hereto that all personnel . <br />of Mayfield Village, while responding to a call for ambulance <br />or emergency medical service by Gates Mills, shall be acting <br />within the scope of their employment as fire personnel of <br />Mayfield Village while enroute to, enroute from, and while <br />acting within the territory of Gates Mills. <br />3. It is further agreed by and between the parties during <br />the term of this Agreement, that Gates Mills will: <br />(a) Rent or purchase and deliver a defibrillator <br />for the exclusive use of the fire personnel <br />of Mayfield Village in performing ambulance and <br />emergency medical service runs, whether such <br />runs are for the use and benefit of Mayfield <br />Village, Gates Mills or pursuant to other mutual <br />aid agreements. <br />- 2-
