-11- <br />(h) Final plan of any water supply system with pipe sizes and location <br />of hydrants. <br />(i) Certification showing the applicant is the landowner and dedicates <br />roads, parks, uGility rights-of-way and other sites For public use. <br />(j) Certification by a registered engineer to accuracy o£ survey and <br />plat and placement of monuments. <br />(k) Certification by the Board of Appeals that the subdivider has <br />complied with one of the £ollowing alternatives: <br />1. All improvements have been installed in accord with the <br />ordinance standards, or <br />2. A security bond has been posted in sufficient amount to <br />assure such completion of all required improvements. <br />(1) Certification of approval to be signed by the Secretary of the <br />Board of Appeals. <br />SECTION 7.0 <br />The Board of Appeals may permit modifications in subdivision provisions under <br />the following conditions: <br />(1) Because of the unique topographic or other conditions o£ the land <br />involved, literal application of the provisions of the Ordinance would be imreasonable <br />or impose undue hardship. <br />(2) Conditions are attached to plat approval that assure compliance with the <br />requirements of this Ordinance insofar as practical. <br />(3) The puxposes and intent of this Ordinance are observed. <br />(4) There is no increase in the flood hazard or flood damage potential. <br />SECTION 8.0 PENALTIES FOR VIOLATION <br />Violation of the provisions of this Ordinance or failure to comply with any <br />of its requirements (including violations of conditions and safeguards established <br />in connection with conditions) shall constitute a misdemeanor. Any person who <br />violates this Ordinance or fails to comply with any of its requirements shall upon <br />conviction thereof be fined not more than $100.00 or imprisoned for not more than 3 <br />days, or both, for each lot subdivided in violation of this Ordinance, and in addition <br />shall pay all costs and expenses involved in the case. Nothing herein contained shall <br />prevent Mayfield Village from taking such other law£ul action as is necessary to <br />prevent or remedy any violation. <br />SECTION 9.0 DEFINITIONS <br />Unless speciPically defined below, words or phrases used in this Ordinance <br />shall be interpreted so as to give them the meaning they have in common usage and to <br />
