In the event the Landowner shall fail to take <br />either of these alternate actions within said time, he shall <br />be deemed to have abandoned the Plan and final approval shall <br />be deemed to have been denied. Any such public hearing shall <br />be held within 45 days after request for the hearing is made <br />by the Landowner, and notice thereof shall be given and the <br />hearing shall be conducted in the manner prescribed in Sec- <br />tion 8 of this Ordinance. within 45 days after the conclu- <br />sion of the hearing, the Council shall by resolution either <br />grant final approval to the Plan or deny final approval of <br />the Plan; such resolution shall, in cases arising under this <br />paragraph (d), be in the form and contain the findings <br />required for a resolution on an Application for Tentative <br />Approval set forth in Section 9 of this Ordinance. <br />(e) A Plari, or any section thereof, that has been given <br />final approval by Council shall be so certified by the Village <br />Clerk-Treasurer and shall be filed of record forthwith in <br />the Office of the Cuyahoga County Recorder; no development <br />may commence prior to such filing and thereafter no develop- <br />ment shall take place except in full compliance therewith. <br />(f) Pending final completion of development of said <br />Planned Development District or of that area thereof, as the <br />-case may be, that has been finally approved, no modification <br />of the provisions of said Plan, or area thereof, as finally <br />approved, shall be made. <br />-23- <br />
