03/10/2004 15:53 FAX 2167314483 HOVANCSEK ASSOC -~ DOUG METZUNG C~j003 <br />MEMORANDUM OF UNDERSTANDING BETWEEN <br />THE CUYAHOGA COUNTY DISTRICT BOARD OF HEALTH <br />AND <br />THE VILLAGE OF MAYFIELD <br />THIS AGREEMENT MADE this day of , 2004 by and between The <br />Cuyahoga County District Board of Health (hereinafter- Board) and The Pillage of Mayfield (hereinafter <br />Village) to provide storm water activities located within the Village. <br />A. DUTIES AND RESPONSIBILITIES <br />1. The Board will survey the Village of Mayfield's MS4 outfall locations and provide the village with the <br />locations of these locations. The information provided will include a digital photograph, number of the <br />outfall, and GPS coordinates. The Boazd will provide the Village a binder with all outfalls as well as a copy <br />of the computer database once all information.is collected within the community. The Board will provide an <br />annual summary to the Village of the work that was performed to be included for inclusion in the Village's . <br />Phase II Storm Water Animal report to the Ohio EPA. This work will be completed in 2004. <br />2. The Boazd will monitor the outfall locations during a dry weather period (72 hours no rain event) over the <br />2005 report period. The Board will then sample up to 25 areas located within the Storm Sewer System where <br />dry weather flows were noted and located within the Village for fecal coliform during the 2005 report period. <br />The Board will provide an annual summary to the Village of Mayfield of the work that was performed as well <br />as the sample results to be included in the Village's Phase II Storm Water Annual report to the Ohio EPA. <br />3. The Village will provide the following information and services to the Board: (1) Provide a map that shows <br />the storm sewer locations and streets within the Village. (2) Pay for the above stated work, not to exceed <br />$5,300.00, and (3) Where needed, provide aid in opening storm sewer manholes for the purpose of sample <br />collections. The invoice will be sent to the village once all work is completed in the 2005-report period. <br />B. TERM. <br />1. The term of this agreement shall be from April 1, 2004 to December 31, 2005. Either party may cancel this <br />Agreement, for cause, with sixty (60) days written notice to the other party of such intent, when either the <br />progress or results achieved under this Agreement is unacceptable to either party. Prior to cancellation of tllis <br />Agreement, a meeting will be held by the parties to discuss issues of concern and seek resolution. If this <br />Agreement is canceled by the parties prior to completion, the Board, within twenty (20) days, shall submit a <br />certified final progress report if a percentage of work is completed by the date of cancellation. Mayfield <br />Village will pay the Board for the work completed as certified in this statement, subject to the provisions of <br />this Agreement.
