Rinker <br />Mayor of the Village of Mayfield <br />Members of Council <br />Village of Mayfield <br />6621 Wilson Mills Road <br />Mayfield Village, Ohio 44143 <br />RE: Charter Amendments <br />Dear Mayor and Council: <br />You have requested my opinion as to the latest date that Charter <br />amendments by Council can be submitted to the Board of Elections. <br />The requirements under the Ohio Constitution are that the Council <br />submit the proposed amendments no later than sixty days before the <br />proposed election date. The election for this year is on November 8, <br />1994. It is my recommendation that the Charter amendments be delivered <br />to the Board of Elections no later than September 7, 1994. <br />You have recently received a recommendation from the Board of <br />Elections that we further amend the Charter to require initiative and <br />referendum matters to be certified to the Board of Elections no later <br />than seventy-five days before the proposed election. They have made <br />this recommendation by reason of the fact that they want your Charter <br />to be consistent with State law which is seventy-five days. Your <br />Charter reads ninety days in Article VII. Also, the recommendation for <br />signing in ink only is a good one. <br />If you like, I can prepare this proposed <br />and have it to you for your next meeting so <br />the ballot this coming November. <br />JWD:nmp <br />amendment for the Charter <br />that it too can appear on <br />,?
