Section 29.2. Special on the job injury leave shall not exceed Ninety (90) <br />consecutive calendar days after the beginning of the leave unless an <br />extension is granted by the Employer. Said leave may be canceled at an <br />earlier time as provided below: <br />A. When the employee is released by his physician to return to work; <br />B. at such time that the employee is declared capable of performing <br />his normal duties by a physician appointed by the Employer. <br />C. If, prior to release for normal duties, it is determined by a <br />physician that the employee is capable of performing limited work <br />assignments, the employee shall immediately report for duty under <br />the conditions set forth in the physician's certificate; <br />D. any limited assignments of duties shall be reviewed each thirty <br />(30) calendar days to determine if the employees is capable of <br />resuming normal, unlimited duties. <br />Section 29.3. The Employer shall have the right to require the employee to <br />have a physical exam by a physician appointed by the Employer resulting in <br />the physician's certification that the employee is unable to work due to <br />the injury as a condition precedent to the employee receiving any benefits <br />under this Article. The designated physician's opinion shall govern whether <br />the employee is actually disabled or not, but shall not govern whether the <br />injury was duty related. <br />ARTICLB 30 <br />SIC'K LSAVS <br />Section 30.1. All permanent full-time employees shall be entitled for each <br />complete eighty (80) hours of service to sick leave of four and six-tenths <br />(4-6/10) hours with pay. Employees may use sick leave with the approval of <br />their department head for absence due to illness, injury, exposure to <br />contagious disease and illness in the immediate family. The head of each <br />department shall require their respective employees to furnish a written <br />signed certificate to justify the use of any sick leave taken. At the <br />discretion of the department head, or anytime an absence due to illness <br />exceeds three (3) days, a statement certifying the nature of the illness <br />from a licensed physician shall be required to justify the use of sick <br />leave. Falsification of either a written statement or a physician's <br />certificate shall be grounds for disciplinary action including dismissal. <br />No sick leave may be granted upon or after retirement or termination of <br />employment. <br />21
