Collective Bargaining Agreement between <br />Mayfield Vil[age and the I.A.F.F. Loca126I9 <br />ARTICLE 30 <br />SHIFT EXCHANGE <br />Section 30.1. Employees shall have the right to exchange shifts with the Fire Chief's <br />permission, when the change does not interfere with the operation of the Fire Department and <br />the number of paramedics on duty does not fall below two (2) and the resulting shift exchange <br />does not result in the payment by the Village of overtime to any employees: Exchanges may be <br />for the entire twenty-four (24) hour shift, or any part thereof, in minimum increments of one (1) <br />hour. <br />Sechon 30.2. All requests for shift exchanges must be submitted in writing to the Fire Chief no <br />later than twenty-four (24) hours in advance of the requested exchange. All requests must be <br />signed by the person requesting the shift exchange and also include the name of the person <br />responsible for covering the hours exchanged. <br />ARTICLE 31 <br />APPLICATION <br />Section 31.1. The Employer agrees that the provisions of this Agreement, along with all work <br />rules and other appropriate regulations, will be administered on a fair and non-discriminatory <br />basis and that such rules or regulations shall not be inconsistent with this Agreement. <br />ARTICLE 32 <br />OBLIGATION TO NEGOTIATE <br />Section 32.1. The Employer and the Union acknowledge that, during negotiations which <br />preceded this Agreement, each had the unlimited right and opporlunity to make demands and <br />proposals with respect to any subject or matter not removed by law from the area of collective <br />bargaining and that the understandings and agreements arrived at by the parties after the exercise <br />of that right and opportunity are set forth in this Agreement. <br />Section 32.2. Therefore, for the life of this Agreement, the Employer and the Union each <br />voluntarily and unqualifiedly waives the right, and each agrees that the other shall not be obligated <br />to negotiate collectively with respect to any subject or matter referred to, or covered in this <br />Agreement, or with respect to any subject or matter not specifically referred to or covered in this <br />Agreement, even though such subjects or matters may not have been within the knowledge or <br />contemplation of either or both of the parties at the time they negotiated and signed this <br />Agreement. <br />Section 32.3. This Article shall not operate to prevent negotiations over any subject the parties <br />may mutually agree to negotiate during the term of this Agreement. <br />Page 31 of 38
