Collective Bargaining Agreement between <br />Mayfield Village and the I.A.F.F. Loca12619 <br />ARTICLE 37 <br />DURATION <br />Section 37.1. This Agreement shall be effective January 1, 2006 and shall remain in full force and <br />effect until December 31, 2010, unless otherwise terminated as provided herein. <br />Section 37.2. If either party desires to modify, amend or ternunate this Agreement, it shall give <br />written notice of such intent no earlier than one hundred twenty (120) calendar days prior to and no <br />later than ninety (90) calendar days prior to the expiration date of this Agreement. Such notice sha11 <br />be by certified mail with return receipt. Negotiations will commence as soon as practical thereafter. <br />ARTICLE 38 <br />PREVAILING RIGHTS <br />Section 38.1 All rights, privileges and working conditions enjoyed by the employees at the <br />present time which are not included in this Agreement shall remain unchanged unless by mutual <br />consent of both the Village and the union. <br />ARTICLE 39, <br />TERM OF AGREEMENT/NEGOTIATION PROCEDURE <br />Section 39.1. This agreement shall be effective as of January 1, 2006 and shall remain in full <br />force and in efFect until December 31, 2010. <br />Section 39.2. This Agreement sha11 continue from year to year beyond the original term hereof <br />unless either party notifies the other in writing of its intent to amend, modify, or ternunate the <br />Agreement by certified U.S. mail not later than ninety (90) days nor earlier than one hundred <br />twenty (120) days prior to the expiration date of the Agreement. <br />Section 39.3. The parties shall meet at a place and time mutually convenient as soon as <br />practically possible after receipt of such notice in order to begin negotiations in good faith for a <br />successor agreement, pursuant to the following guidelines: <br />A. Location of ineetings <br />Meetings will be held on the premises of the Employer. <br />B. Dates and times of ineetings <br />Sessions will be scheduled by mutual agreement on an as needed basis and will last for <br />no more than three (3) hours in duration. If further meeting time is required following <br />adjournment, nothing herein shall limit the parties from mutually consenting to <br />schedule a limited agenda meeting immediately following the regularly scheduled <br />meeting. <br />Page 33 of 38
