Agr''eeynent between Mayfield Village and F.O.P. Lodge 57 <br />ARTICLE 3 <br />AGENCYSHOP/DUES DEDUCTION <br />Section 3.1. Upon the effective date of this agreement, or within thirty (30) days thereafter, all <br />employees in the bargaining unit shall either become dues-paying members of the F.O.P., or, as a <br />condition of continued employment, remit to the F.O.P. a fair share fee, to be determined in <br />accord with the provisions of Oluo Revised Code Section 4117.09(C). Any newly-hired <br />employees in the bargaining unit sha11, upon completion of sixty (60) days of employment with <br />the Employer, either elect to become members of the F.O.P. or remit the fair share fee. Nothing <br />in this Article shall be deemed to require any employees to become a member of the F.O.P. The <br />payment of union dues or a fair share fee does not in any way affect the Employer's rights as <br />detailed in Article 7 below. <br />Section 3.2. The Employer agrees to deduct F.O.P. dues from any F.O.P. member of the <br />bargaining unit who provides written authorization for a payroll dues deduction. Fair share fees <br />shall be deducted pursuant to Ohio Revised Code Section 4117.09(C) and the F.O.P. sha11 <br />indemnify the Employer and hold it harmless against any and all claims, demands, suits or other <br />liability that may arise by reason of any action of the Employer in complying with the provisions <br />of this Article. <br />Deductions for dues and fair share fees will be made at least on a monthly basis, and paid to <br />Treasurer, F.O.P. Lodge #57 (Mayfield Village Division), with the Employer providing a list of <br />those employees for whom dues and fair share fee deductions have been made. <br />Section 3.3. Total dues withheld from those employees authorizing a dues deduction shall be <br />tendered to the Treasurer of the F.O.P. within fifteen (15) days from the date of making said <br />deductions. <br />ARTICLE 4 <br />11IANAGEMENT RIGHTS <br />Section 4.1. It is agreed that the Employer reserves all the customary rights, privileges, or <br />authority of management, except as modified by the terms of this Agreement including, but not <br />limited to, the following: <br />A. determine matters of inherent managerial policy which include; but are not <br />limited to, areas of discretion or policy, such as the functions and programs of the <br />2
