Collective Bargaining Agreernent between Mayfield Village and the I.A.F.F. Loca12619 _ proposals with respect to any subject or matter not removed by law from the area of collective bargaining and that the understandings and agreements arrived at by the parties after the exercise of that right and opportunity are set forth in this Agreement. Section 32.2. Therefore, for the life of this Agreement, the Employer and the Union each voluntarily and unqualifiedly waives the right, and each agrees that the other shall not be obligated to negotiate collectively with respect to any subject or matter referred to, or covered in this Agreement, or with respect to any subject 'or matter not specifically referred to or, covered in this Agreement, even though such subjects or matters may not have been within the knowledge or contemplation of either or both of the parties at the time they negotiated and signed this Agreement. Section 32.3. This Article shall not operate to prevent negotiations over any subject the parties may mutually agree to negotiate during the term of this Agreement. ARTICLE 33 LEGISLATIVE APPROVAL Section 33.1. It is agreed by and between the parties that any provision of this Agreement requiring legislative action to permit its implementation by amendment of law or by providing the additional funds therefore, shall not become effective until the appropriate legislative body has given its approval. ARTICLE 34 SEVERABILIT~' Section 34.1. In the event any one or more provision(s) of this Agreement is or are deemed invalid or unenforceable by any final decision of a court or governmental agency, that portion(s) shall be deemed severable from the rest of the Agreement and all such other parts of this•Agreement shall remain in full force and effect. Section 34.2. If in the event any provision is so rendered invalid, upon written request of either party hereto, the Employer and the Union shall meet within thirty (30) days for the purpose of negotiating a satisfactory replacement for such provision. Section 34.3. Any negotiated change must be reduced to writing and signed by both parties to be effective and incorporated into this Agreement. ARTICLE 35 WAIVER IN CASE OF ENIERGENC~' Section 35.1. In cases of emergency declared by the President of the United States, the Governor of the State of Ohio, the Mayor of Mayfield Village, the federal or state legislature, such as acts of God, the following conditions of this Agreement shall automatically be suspended: 28 --
