1~9 <br />torium could be placed on building in the Village now. <br />Mr. Grogan said Council did not mention any thing about a moratorium - <br />the Mayor did, and he would like to reserve any talk about a moratorium <br />until after the meeting on the 5th. <br />Mayor Beebe said he had put together information re the matter for <br />Council and if anyone has a desire to have it again please say so. <br />Mrs. Hanus and Miss Trask indicated they would like the in"formation. <br />Mr. Avery said we are on notice that the condition exists. What was <br />allowed in the first place was wrong and the more problems that occur, <br />the more the possibility~of liability on us because"of the raw sewage. <br />If Council waits until after the November 5th meeting and another break <br />occurs, the Village is subjecting itself to liability. We owe it to <br />the residents to stop the building at least until after the meeting. <br />Mr. Grogan stated that Wickliffe has been sued for doing the thing <br />the Mayor is asking. <br />Mr. Bennett agreed that we might be cutting off our nose to spite our <br />face as Mr. Busa had indicated that we would be losing revenue from the <br />Industrial Park. <br />Mr. Avery said we would be better off with a third party law suit than <br />risking a resident being hurt. <br />Mayor Beebe questioned Mr. Hovancsek on the building situation. <br />Mr. Hovancsek stated that Phase II of Aintree North is about ready to <br />go with some 50 units and Hanover Woods Phase I has been approved with <br />60 units. Mayfield Heights Four Seasons Apt. complex will effect the <br />Pumping Station. Plus the building on our Industrial Park. <br />Mayor Beebe said he was certainly interested in the revenue but not to <br />the extent of overlooking the residents needs. <br />Mr. Flynn "said Steve's recommendation for a by-pass has been ignored by <br />the County. <br />Mr. Hovancsek explained his recommendations and that a study has been <br />done by the Havens & Emerson Company and a total permanent solution is <br />not feasible. <br />Mr. Avery said we a.re being studied to death and we should not wait any <br />longer. <br />Mrs. Hanus questioned if we put a moratorium on the building would the <br />Coun ty enforce it. <br />Mr. Hovancsek stated that four or five months ago the same thing happened <br />with Highland Heights but the County weakened with the pressure from <br />the contractors. <br />Mrs. Hanus said she still didn't feel anymore building should be allowed <br />until something is done. <br />
