o~ ,G <br />-4- <br />Mr. Bennett advised that the Budget/Appropriations Committee has <br />reviewed the budget and recommended it to Council for approval. <br />Mr. Buses, seconded by Mr. Bordonaro, made a motion to suspend the <br />rules of law requiring an ordinance to be read on three separate <br />occasions. <br />Roll Call: r'~YES: Messrs., Barclay, Bennett, Bordonaro, Busa, Flynn, <br />Grogan and Schulte <br />NAYS: None <br />Motion Carried <br />Rules Suspended <br />Mr. Bennett advised that the budget must be passed before April 1. <br />Mr. Busa, seconded by Mr. Schulte, made a motion to pass Ordinance 77-14. <br />Mr. Schulte questioned that if we vote yes on the bottom line items, <br />can we vote against line items at time of needed approval. <br />Mr. Byrnes stated yes. He also said that the Mayor can veto the <br />ordinance in part or in whole on finance matters only. <br />Mr. Barclay aslced Mr. Relic if there is anything in the budget for <br />street repairs. <br />Mr. Relic replied that approximately $23,000 has been appropriated. <br />Major street repair work was done last year. <br />Roll Call: AYES: Messrs., Barclay, Bennett, Bordonaro, Busa, Flynn, <br />Grogan and Schulte <br />NAYS: None <br />Motion Carried <br />Ordinance Passed <br />Resolution 97S, entitled; "A RESOLUTION AUTHORIZING 'AND DIRECTING <br />SPIETH, BELL, McCURDY & NE~57ELL CO., L.P.A. TO PROVIDE NIAYFIELD VILLAGE <br />%VITH A DEFENSE IN THE MATTER OF JOSEPH PALERMO ET AL. VS. VILLAGE OF <br />Iv1~~YFIELD, CUYAHOGA COUNTY COMMON PLEAS COURT CASE X77-966659", taas <br />introduced by Niayor Beebe. <br />Mr. Bordonaro, seconded by Mr. Schulte, made a motion to adopt <br />Resolution 978. <br />Mr. Barclay stated that ~~re should specifically appoint a law firm for <br />each specific case. Let's keep costs down. Palermo case is identical <br />to Myotte case. It would be less expensive to hire the same la~~~ firm <br />rather than hire a new firm to start research procedures. <br />Mayor Beebe read a portion of a letter sent to all Council dated <br />3-11-77. As far as he is concerned according to Ord. 77-4, passed <br />2/21/77, I4r. Byrnes is to continue as law director until a successor <br />is appointed <br />
