5• <br />perty was spot zoned and should be restored back to its best use which <br />would conform with the rest of the surrounding property. <br />The sewage problems that exist today are overwhelming enough without <br />the addition of any high rise which would create problems of population, <br />density and further aggravate existing health problems caused by, a- <br />mong other things, a vastly insufficient sewage system. I think the <br />considerations which governed council's action around 1960 are no <br />longer valid and must he reversed as circumstances have changed. I <br />d,n't believe any tax advantage that might be gained could outweigh <br />the problems to health, safety and the people's welfare high rises <br />would bring. <br />Now to the question, 'Do we have a chance?' To try and predetermine <br />what a judge or jury might ultimately decide is the willy-nilly nega- <br />tive approach. We can't determine that. Our task at this time is <br />to decide on what is reasonable and for the best interest and welfare <br />of our constituents. <br />For the safety, health and welfare of the people of Mayfield Village, <br />whom we so clearly heard at the public hearing, I beg that council <br />support the recommendation of the Planning and Zoning Commission who <br />voted unanimously to approve the rezoning to single family. <br />Now, gentlemen, is the time to show unity in our villagee The peo- <br />ple have spoken, the Planning and Zoning Commission has approved <br />Ordinance #72-1. Now is the time to stand UNITED." <br />NIr. Schmidt said, "he had mixed emotions relative to health, safe- <br />ty arid traffic welfare. What will we gain by having a high rise <br />there? I'm asking council to stay together in the zoning back ta <br />residential." <br />Mr. Bordonaro, seconded by Mr. Braun, moved that Ordinance rt72-1 <br />be approved and passed as read. Roll Call: aY'iS: Yiessrs. Boger, <br />Bordonaro, Braun, Davis and Schmidt. ABSTAIN: Mr. Leech. <br />Motion Carried <br />Ordinance Passed <br />Mr. Schmidt stated, "that noting the road situation he moved to re- <br />consider the 50/ or a minimum of 65%, income tax credit be brought <br />into play." Referred to the Finance Crmmittee. <br />ORDITi.ANCE #72-15: Messrs. Leech/Bordonaro introduced ORDINANCE <br />,1'J2-15; Entitled: "AN ORDINti1VCE TO 1aMEND ORDIidANCE #159, THE ZONING <br />ORDINaNCE, BY CREATING A PLANNED DEVELOPNENT DISTRICT ZONING CLASS- <br />IFICATION FOR THE VILLAGE OF MAYFIELD, OHIO.'o Referred to Planning <br />and Zoning Commission. <br />Councilman and Mrs. Davis supplied the refreshments for this meeting <br />and Mayor Beebe wished to acknowledge their courtesy as he forgot to <br />include it in the agenda.
