124 <br />Aintree North Drainage - Mr. Pat Caticchio??e was at the last Cotincil Meeting <br />requesting approval to complete the channel from the cemetery to SOM Center <br />Road, because of the problems he is having with the people in the subdivision. <br />he said at that time Council had requested a letter stating that the Aintree <br />North Development Company would do the lower channel promptly once they' <br />resolved the problems with the homeowners. He said that letter specifically <br />states that. He said the only condition they have is that they get something <br />in writing from the Village that once they finish the western end of the channel <br />that permits will be issued for Sublots 80-85. <br />Mr. Feneli asked if that would create any problems. <br />Mr. Hovancsek explained that it will create a large channel west of properties <br />that we don't have right of access to do the work on. He said it will act as <br />a sort of holding area which will be a plus that we don't have now. He said <br />he thought it would be agood idea; he recommended..:several months ago that this <br />be used to get some of that work done. He said in that letter they also agreed <br />to do the work on the east side of Timberline Trail. <br />Mr. Basile asked that would happen if we don't get the right of entries from them. <br />Mr. Caticchio confirmed that we would have a problem. <br />Mr. Caticchio said that they have existing easements along the rear yard lines <br />where they originally started to construct the channel. They were stopped by <br />the homeowners because they were going to have to remove some of their trees. <br />Mr. Feneli said he would prefer to wait until after.: the meeting held next Monday. <br />He said if Mr. Hovancsek said the cemetery matter is not intricately connected, <br />that Council could authorize the Council President and Mayor to write a letter <br />of understanding with the Aintree North Development Company. <br />Mr. Hovancsek said the only problem he sees would be if there was additional <br />cost later on that would require these rights of entry, that Council should be <br />aware of it. <br />Mr. Feneli said there should be a hold-harmless agreement made that if Council <br />has to make appropriations easements that Aintree North Development Company <br />must reimburse the municipality. <br />Mr. Caticchio said that all of the water that is going into that channel from <br />SOM Center Road is coming off-side, from the west side of SOM Center Road. (Almost) <br />none of the water is coming off of Aintree North. <br />Following further discussion, Mr. Basile said that _aftez the meeting held on <br />Monday, August 24, if necessary, a Special Meeting will be called to address <br />this issue. <br />11 <br />r--, <br />? <br />I
