1 7- `-i <br />Regular Council Meering <br />10/21/91 <br />Page Four <br />eminent domain proceedings. Mr. Riehl said his people had detemuned they would rather wait for <br />the outcome of the election. Mayor Carmen said he talked to Mr. Riehl at 11:30 this morning and <br />advised him that if he and Council did not hear back from him, that it is his will and that of the <br />majority of Council, to take the offer off the table. He said their will has been frustrated and <br />undermined by the actions of one of the members of Council. It was inappropriate and not in the <br />best interest of the Village. Mayor Carmen said that as of tonight at 8 p.m. the consensus of <br />Council is that our offer is off the table and we will proceed with eminent domain proceedings and <br />the Federal lawsuit. <br />Mr. Rinker said we need to find out, what, if anything happened; and what procedure we need to <br />follow. He thinks Council needs to invesrigate this matter in some fashion. He saad the Village <br />has tried to resolve this for a long time and what happens with Pazkview has a very significant <br />unpact on the Village. <br />Mr. Flynn asked why he was not privy to the information or included in the consensus of Council. <br />He asked where the Mayor got the authority to give a deadline for our offer. <br />? <br />? <br />Mr. Rinker said we all agreed that Mayor Carmen was authorized expressly to indicate the teirris of <br />the acceptance by Council. It is exceedingly frustrating and embarrassing because the actions of an <br />individual may have frustrated our efforts. By wanting to wait until after the election, the <br />LaContes are direcdy implicating that polirics aze involved in their decision. <br />Mr. Flynn said he understands that Mayor Carmen has the authority to go forward in a certain , <br />fashion-- but how he can give a deadlme for the deal. <br />Mayor Carmen said he spoke to a majority of Council. . <br />Mayor Carmen said that Mr. Pietrafese has admitted he has had conversations with the LaContes. <br />Mr. F1ynn said that he has been excluded a number of rimes and has not been made privy to a <br />number of items. <br />Mr. Ramos said it was his impression that Mayor Carmen had talked to a majority of Council. <br />Mr. Rinker said that he does not know what the course of action is, but everyone on Council will <br />have a chance to discuss this point. Mr. Flynn's question will be part and parcel of that process. <br />He asked if anyone felt differently. <br />There were no comments. <br />Mr. Fietrafese said he wants Council to lrnow that he would not jeopardize, whether a political <br />candidate or not, he does not understand giving LaContes a time frame to either accept or reject our <br />offer. It is unheard of. Mr. Pietrafese said that he did meet with the LaConte's on two different <br />occasions; both of which were in regard to his campaign. Mr. Pietrafese said at the last meeting he <br />had lunch and the subject was brought up; and he said to Mr. Richard LaConte Jr. and Mr. Busa <br />and Mr. Eisenberg that he was not privy to discuss anything that was talked aboug or discussed in ---?; <br />Executive Session.
