262
Regular Council Meeting
10/17/94
Page Ten
Mr. Diemert said he does not believe they would be in any better negotiating position; it
would be redundant to try to re negotiate this contract now.
Mrs. Cinco asked for a roll call vote.
Mr. Busa, seconded by Mr. Basile, made a motion to suspend the rules of Council
requiring an ordinance to be read on three separate occasions.
ROLL CALL: AYES: All
NAYS: None Motion Carried
Rules Suspended
Mr. Busa, seconded by Mr. Basile, made a motion to enact Ordinance No. 94-37.
ROLL CALL: AYES: All
NAYS: None Motion Carried
Ordinance Enacted
VEW BUSINESS 1
Consideration of Variance Request by Paris Properties
IVIr. Paris said they have had many different requests for use of the building (none of
which panned out.) This one, they feel, is a logical and a good request to have a
physical therapy lab and rehabilitation facility. Most of the customers will come from
the industry around this area. Mr. Paris said they have sent over an explanation of
what Nova Care does and have provided a detailed plan of the facility. He introduced
Deborah Singer who will run the operation. Mr. Paris said they are available for
discussion.
Mr. Diemert said this district is zoned Production-Distribution. The use itself was
determined by the Building Commissioner to be more appropriate for a small business
office building. It does not mention a medical office; it is a medical-type facility. It was
a determination that this was more similar to that type of activity than it was to
Production-Distribution. As a result, it was necessary for the Building Commissioner to
reject the application and refer Mr. Paris to Council for a variance. Council has
exclusive control over variances in a commercial district.
Mr. Paris said this is strictly physical therapy and rehabilitation. There is no medical
component.
