258 <br />Regular Council Meeting <br />10/17/94 <br />Page Six <br />Mayor Rinker clarified that if it is the Engineer's estimation the contractor has done <br />damage to the road surface, it should be contractor's responsibility to restore the <br />damaged area. At least an overlayment should be put down until it can be properly <br />restored. He has assured the residents that it will be done. <br />Mr. Hovancsek stated that it is a cost of several hundred dollars, not thousands, and he <br />will remind them the Village has a bond on the existing portion of Bonnieview. It is a <br />matter of interpretation if it is located on the existing street or on the new portion. <br />Mayor Rinker also pointed out the small strip that is from Wilson Mills to the ravine. <br />Are they disputing they have torn up that area? <br />Mr. Hovancsek stated that the first 100 feet is in pretty good shape; there is a little bit of <br />eclge that is damaged on both the east and west side. The rest of the pavement surface <br />looks pretty good. When he discussed it with Mark, he told them the entire area should <br />be one continuous resurfaced pavement. At this time, the contractor does not want to <br />pay for it. It is really in pretty good shape except for the two edges. <br />Mayor Rinker asked for clarification. <br />Mr. Hovancselc stated that he is trying to get him to do it but he does not know if the <br />Village can force him to do it. Yf they cut out and restore those two areas to the full <br />depth in an acceptable fashion, it will put that section of the road in good shape. It is <br />his opuuon that the most important issue is getting the south side where Bonnieview <br />and Beech Hill come together restored. Should be done by them at their expense. <br />Regarding the pole issue; it can be placed only where the Village permits it to be placed. <br />Mayor Rinker stated they had placed a pole on a residents property without approval. <br />There are three points that must be resolved and Joe Diemert is to be kept informed. <br />1VIr. Flynn stated the bond should be used. <br />Mr. Hovancsek stated that the Village cannot direct their contractor; he will discuss the <br />progress with the Mayor and Joe Diemert. <br />Highland/SOM <br />Mr. Hovancsek reported he spoke with the contractor as well as the Cleveland Water <br />Department. The water work is all being done. Last week, they corrected a valve; <br />today, they are working on a water main. He spoke with the paving company who <br />indicated they will be in the middle of next week to do the corrective work to the <br />pavement.
