260 <br />Regular Council Meeting <br />10/17/94 <br />Page Eight <br />Mr. Fixler said if you are going out to bid for the fire station and if you have an <br />architectural firm such as this one and a competent construction company that has a <br />construction manager as part of the team, he is concerned there may be an overlap of <br />duties and dollars between the architectural firm and the Panzica contract. If we are <br />going to accept the contract the way it is, are we saying that we can bypass some of the <br />steps in the Panzica contract we have currently or do we need another construction <br />manager. <br />Mr. Brett said the history on this is that these two contracts were considered together <br />back in 1991. One was signed and, for one reason or another, the architectural contract <br />was not signed. One of the provisions of the construction manager's contract is that if <br />for one reason or another he decides to terminate that contract prior to construction, <br />there is a$10,000 fee that is paid to the construction manager. <br />Mr. Fixler asked if construction managers were hired for other fire stations in addition <br />to an architectural firm and the company that is actually doing the work. <br /> <br />Chief Mohr said no, but Panzica is doing a tremendous amount of work. <br />Mr. Fixler said he recalls part of the contract restricts Panzica from bidding on this <br />project. He wonders if since he has built so many of them we are not shooting ourselves <br />in the foot because Panzica Construction Company would be a low bid. <br />Mayor Rinker said there was a very lengthy interview process whereby Council <br />selected Rauschenbach and Casini after interviewing a number of architectural firms. <br />Mayor Rinker said he does not think there should be any second thought about <br />proceeding, we want to make sure that we are confirming that we have already <br />represented we would go with Rauschenbach and Casini. He asked to get that <br />straightened out. Secondarily, the points Mr. Fixler brought up--his understanding is <br />that the contract with Mr. Panzica is not a final contract. If, by the terms that were <br />agreed upon in 1991-92 there was a self-executing provision if it did not go forward. <br />Then, realistically, we may not have a contract with him--so Council can reconsider <br />whether or not it needs to retain Mr. Panzica as Construction IVlanager. He believes <br />they need to reassess what value it may have. <br />Mrs. Cinco said this resolution tonight is strictly for Rauschenbach, Casini and Urban. <br />She will include Mr. Panzica on the November Caucus.
