284 <br />Regular Council Meeting , <br />11/21/94 Page Ten <br />Mr. Busa, seconded by Mr. Basile, made a motion to authorize release of the retainage <br />for the 1994 asphalt street repair program to Velotta Paving in the amount of $622.80. <br />ROLL CALL: AYES: All <br />NAYS: None Motion Carried <br />Authorization Given <br />First Reading of Ordinance No. 94-51, entitled; "An emergency ordinance authorizing <br />an agreement for construction management with Panzica Construction Company." <br />Introduced by Mayor Rinker and Council as a Whole. <br />Mr. Fixler, seconded by Mr. Buckholtz, made a motion to suspend the rules of Council - <br />requiring an ordinance to be read on three separate occasions. ' <br />ROLL CALL: AYES: All <br />NAYS: None Motion Carried <br />Rules Suspended <br />Mr. Fixler, seconded by Mr. Buckholtz, made a motion to enact Ordinance No. 94-51. <br />Mr. Fixler said in reviewing the contract it pretty well covers that the Panzica <br />Construction Company cannot bid on any of its projects, but it was a little unclear that <br />none of the materials could be purchased from them. He wants to be sure that materials <br />cannot be purchased from Panzica Construction Company in any way, shape or form. <br />Mr. Diemert said it is pretty clear in the subcontract provisions and in the standard form <br />of agreements that are referenced in this document. We will have to approve all <br />subcontracts for all purchases of materials and service. It will be disclosed to us. We <br />did not want to strike it as an option. Clearly, it would be a conflict of interest for <br />almost everything. If there happened to be some unique thing that we wanted to <br />approve, and we approved it ahead of time and knew very well what it was--the door is <br />still open, but it will require Village approval. <br />Mr. Flynn asked if Mr. Brett will be a liaison with Mr. Panzica and his company on <br />money flows and changes in work orders. <br />Mr. Brett said he thinks Mr. Samac will give him a great deal of assistance in that role. <br />We will be handling cash flows. <br />Mayor Rinker said Mr. Brett will handle money matters. There will not be one person <br />designated; it will be a shared responsibility.
