5 <br />Regular Council Meeting <br />7/1/96 <br />Page 4 <br />Third Reading of Resolution No. 96-14, entitled; "An emergency resolution adopting a policy and <br />procedure for qualifications based selection for professiona.l services." Introduced by Mayor <br />Rinker and Council as a Whole. (First Reading 5/20/96, Second Reading 6/17/96.) <br />Mr. Busa, seconded by Mr. Ferrante, made a motion to adopt Resolution No. 96-14. <br />Mr. Hovancsek suggested the legislation be amended because it is inconsistent with HB 231. (He <br />had sent a memo out last week about this.) Mr. Hovancsek said the House Bill preciudes getting <br />a proposal from more than one firm at a time and explained the procedure per HB 231. <br />Mr. Diemert said Council can do what it wants--the House Bill waspatterned after existing State <br />law. According to the legislature now, if more than one person or -firm is deemed qualified, the <br />fee submittal is a tie-breaker between those who are most qualified. If you determine there is only <br />one person most qualified, then only they need to submit the fee bill. If you determine there are <br />three most qualified, then you have the ability to have all of them submit fee bills and then decide <br />from those three. <br />Council President Fixter asked Mr. Diemert if he sees any problem if Council goes ahead with the <br />legislation as it is. <br />Mr. Diemert said no. Per our reading of the new House Bill and administrative code as it exists, if <br />you have a tie among those who are equally qualified, you can get a fee bill from all three. He <br />wrote a letter to Council and the Mayor on May 17 expiaining the new law that went into effect <br />this year and on January 16, he gave all the details of the law. It only deals with engineering fees <br />and services and surveying services. Mr. Diemert said you will only set up this qualifications <br />based selection process this one time. Then, you put the engineers in the rank you want to <br />consider them preferred. That panel created by Council tonight does that. In the future, when <br />you have a project, you can only consider the first engineering firm ranked to do that project. <br />A brief discussion was held. <br />Mr. Marquardt noted that the procedure Council must follow is spelled out rigidly in the appendix <br />(attached to the legislation.) <br />Mr. Diemert said the procedures are per State law. <br />
